225 Union Blvd., Suite 600 Lakewood, CO 80228 RE: Energy Fuels Resources, White Mesa Uranium Mill, December 9, 2020, Second Request for an Extension of Time to Submit the Groundwater Background Report for
Monitoring Wells MW-38, MW-39, and MW-40, Utah Groundwater Discharge Permit No. UGW370004 Dear Ms. Weinel:
The Division of Waste Management and Radiation Control (DWMRC) has reviewed the Energy Fuels Resources (USA) Inc. (EFR) December 9, 2020 letter requesting an extension of 60 days to submit the Groundwater Background Report for monitoring wells MW-38, MW-39, and MW-40 at the White Mesa Uranium Mill (EFR Letter). Submission of the Background Report is required by Section I.H.3.c of the Groundwater Discharge Permit. Per the letter, an additional 60 days is needed “due to the inefficiency of
teleworking and the concurrent data review and data management associated with the Low Flow
Sampling Program, which was conducted in the fourth quarter 2020.” As noted by DWMRC and discussed in the EFR Letter, this is the second extension of time request
made by EFR for the MW-38, MW-39, and MW-40 Groundwater Background Report. A previous 90-
day extension was approved per a September 1, 2020 DWMRC letter. The previous extension was needed for EFR to collect additional data at monitoring wells MW-39 and MW-40; to provide statistically valid data sets. The EFR Letter does state that all needed data has been collected per the previous request for an extension of time.
The EFR Letter requests that the due date for the Background Report be further extended until March 9, 2021. Based on review, the extension request is approved, however, please note that based on this being a combined extension of 150 days to submit the background report it is unlikely that further extension will be granted. Please submit the MW-38, MW-39, MW-40 Groundwater Background
Report on or before March 9, 2021.
