HomeMy WebLinkAboutDDW-2024-013061 November 5, 2024 Thomas G Isom Erda Acres Water Co PO Box 11 Tooele, Utah 84074 Subject:Disapproval, Updated Drinking Water Source Protection Plan for Well #2 Nelson and Well #3 Campbell; Erda Acres Water Co; Water System #23053, Source No. WS002 and WS003 Dear Thomas G Isom: The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for Well #2 Nelson and Well #3 Campbell from you on December 15, 2022. Division staff requested a revised update via email on May 28, 2024. A revised update was not received. We have completed our review of the updated DWSP plan; however, before we can concur with the updated plan, the requirements listed below must be addressed and the plan resubmitted for review. Requirements Your updated plan mentioned that livestock is located within the protection zones, however, this was never inventoried as a potential contamination source (PCS). Since livestock have the potential to contaminate your sources, please add them as a PCS and assess. Keep in mind that uncontrolled PCSs cannot be allowed in zone one of your sources. When assessing this PCS, provide detailed information on what the property owners are doing to prevent groundwater contamination. Also, be aware that pollution sources cannot be located within zone one of these sources. If the livestock within zone one meets the definition of an animal feeding operation — more than ten animal units (5 horses) are stabled or confined for 45 days out of a 12-month period, and forage vegetation is not sustained in any portion of the lot — then the livestock may be considered a pollution source. According to R309-600-7(2), each public water system shall correct any deficiencies in a disapproved DWSP plan and resubmit it to the Division within 90 days of the disapproval date. A dormant deficiency (SP04 ACTIVE SOURCE LACKS APPROVED UPDATES TO DWSP PLAN) has been added to the Division’s database to serve as a tracking tool and reminder.If you have any questions about these points, please contact Jennifer Yee at (385) 515-1501 or ddwips@utah.gov.If you cannot address the deficiency within 90 days, please request a Corrective Action Plan (CAP) at requestcap.utah.gov. You must request the CAP before the deficiency has been assessed.
