Box 144850 Salt Lake City, UT 84116-4850 o 3£ CP 56 < Cy. Spntro\ Re: State of Utah Ground Water Discharge Permit No. UGW370004 White Mesa Uranium Mill - Removal of Certain Groundwater Monitoring Parameters from Accelerated Monitoring Status Dear Mr. Lundberg: A number of groundwater monitoring constituents have been placed on accelerated monitoring status under Part I.G.I of the Energy Fuels Resources (USA) Inc. ("EFRI") Ground Water Discharge Permit No. UGW370004 ("GWDP"). Part I.G.I provides that such accelerated monitoring shall continue until compliance status of the facility can be determined by the Director. Based on the accelerated monitoring results to date, EFRI requests the Director make a determination that accelerated monitoring cease at this time for uranium in MW-25 and MW-30, molybdenum in MW-35, field pH in MW-12, MW-18 and MW-27, and iron in MW-29 for the reasons stated below: • MW-25 uranium results have been below the Groundwater Compliance Limit ("GWCL") specified in the GWDP for ten consecutive sampling events since Q4 2012. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. • MW-30 uranium results have been below the GWCL specified in the GWDP for eight consecutive sampling events since January 2013. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. • MW-35 molybdenum results have been below the GWCL specified in the GWDP for eight consecutive sampling events since Q4 2012. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. • MW-12 field pH results have been within the GWCL limits specified in the GWDP for eight consecutive sampling events since Q3 2011. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. Letter to Rusty Lundberg Removal of Parameters from Accelerated Monitoring November 13, 2013 Page 2 • MW-18 field pH results have been within the GWCL limits specified in the GWDP for eight consecutive sampling events since Q3 2011. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. • MW-27 field pH results have been within the GWCL limits specified in the GWDP for eight consecutive sampling events since Q3 2011. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. • MW-29 iron pH results have been below the GWCL limits specified in the GWDP for nine consecutive sampling events since Q2 2011. Per the UDEQ letters of May 30, 2006, October 31, 2011 and April 25, 2012, eight consecutive sample results below the GWCL are needed for the discontinuance of accelerated monitoring. Once removed from accelerated monitoring status, these constituents, like all other constituents, would be subject to future accelerated monitoring under Part I.G.I of the GWDP, should circumstances warrant. Field pH measurements will continue to be recorded for all samples collected, including any accelerated monitoring completed for other constituents as required. Upon DRC approval of this request, field pH measurements will no longer be tracked and reported as part of the quarterly Exceedance Notice, but will return to the routine reporting in the Quarterly Reports. To assist in your evaluation of the foregoing, we have included a summary of the accelerated sampling results since the initial sample result that triggered accelerated monitoring in Table 1. The analytical laboratory reports for the foregoing results up to and including June 2013 are included in the Quarterly Groundwater Monitoring Reports, all of which have been provided to DRC. Copies of the analytical laboratory reports and the field sheets for the results for July 2013 through September 2013 will be provided in the upcoming 3rd Quarter 2013 Groundwater Monitoring Report and are also included with this letter for your convenience. It is important to note that the 3rd Quarter 2013 monitoring results included with this letter have been evaluated per the DRC approved QAP and the GWDP and all field and laboratory quality control parameters are acceptable. The evaluations of the 3rd Quarter data will be included in the 3rd Quarter 2013 Groundwater Monitoring Report, due December 1, 2013.
