Sampling Report Closeout Letter

The Utah Division of Radiation Control ( DRC ) has completed the review 2011 Annual Seep and Spnngs
Sampling Reports
The review was based on compliance with the
• Groundwater Discharge Permit No UGW370004 ( Permit ) Permit version that was signed by
on February 15 2011
• White Mesa Uranium Mill Ground Water Quality Assurance Plan ( QAP )
Revision 5 0 dated April 20 2010
• Sampling Plan for Seeps and Springs In the Vicinity of the White Mesa Uranium Mill Revision 0
( Plan )
On May 31 2011 DUSA collected seeps and spnngs samples and failed to notify the Executive Secretary
in advance of this sampling event therefore DRC staff was not present to collect split samples This is m
violation of part of Section 3 0 of the Plan which states
DUSA will provide at least 15 days notice of site visits for sampling purposes during
periods of time when actively flowing locations are likely in order to allow the Executive
Secretary to collect split water quality samples ofthe seeps and springs
However DUSA did notify the Executive Secretary of the inadvertent omission ofthe notification and the
Executive Secretary requested that DUSA resample the seeps and spnngs locations to allow DRC staff to
observe the sampling and collect a split sample On June 28 2011 DUSA responded with a notification to

the Executive Secretary that they would resample the seeps and spnngs on July 13 2011 On July 13
2011 DUSA and DRC staff was there and collected a split sample from Entrance Spnng Therefore the
Executive Secretary believes enforcement discretion is appropnate in this matter and there will be no
enforcement taken against DUSA at this time
All other items reviewed were found to be conducted m compliance with the Permit QAP and Plan This
letter constitutes a closeout of the 2011 Annual Seep and Springs Sampling Report
