SUBJECT: November 29, 2010 White Mesa Mill Discharge Minimization Technology (DMT)
Performance Standard Monitoring Report (DMT Report), and Cell 4A BAT Performance
Standards Monitoring Report (Cell 4A BAT Report) for the 3"^ Quarter, 2010, Submitied
as a Single Volume; Findings and Closeout Letter
We received the subjeci combined DMT and Cell 4A BAT Reports for the 3"^ Quarter, 2010, dated
November 29, 2010. These two reports were submitied as a combined single bound volume under one
title, as shown in the subjeci block above. An electronic copy of the volume was also submitted on
compact disk. We have reviewed this information, and note the following:
Findings:
1. Coniinued inspeciions for the New Decontamination Pad at the mill are recorded in the subjeci
reporl. These inspeciions occuned; although the NDP was nol in use after a cease and desist order
regarding use of the pad was issued by DRC on May 18, 2010.
2. The report in paragraph 3.0 as well as Appendix A shows lhat numerous freeboard exceedances for
Cell 3 occuned during the 3'" Quarter of 2010. A DUSA leller, dated August 4, 2010, conlained in
Attachment B of the report discusses a specific exceedance in this regard. We acknowledge that
the report discusses a history of freeboard exceedances at tailings cells in 2010, which were not
resolved during this reporting period.
3. Paragraph 7.0 of the report discusses liner repairs underway for the Cell 1 liner, as a resull of
discovery of leakage in the Cell 1 LDS on'June 2, 2010 and laler on August 7, 2010. As approved
in a DRC Confirmatory Action Leller (CAL) dated Seplember 22, 2010, DUSA has commilled.to
complele repair of these leaks by July 31, 2012, and submittal of the required repair report by
December 1, 2012.
4. As you are aware as required by the Part I.D.3.b.l oflhe pennit, "the Permittee shall at all times
maintain the average wastewater head in the slimes drain access pipe lo be as low as reasonably

achievable in each tailings disposal cell, in accordance wilh a DMT Moniloring Plan. Compliance
shall be achieved when the average annual wastewater recovery elevation in the slimes drain
access pipe, deiermined pursuant to the cunently approved DMT Moniloring Plan, meels the
condilions in Equation 1 . . ." We note that pursuant to Part LD.3(b) of the Ground Waler
Discharge Permit, that Cell 2 compliance in this matter will be determined after submittal of lhe 4^^
Quarter, 2010 DMT Monitoring Report.
Close-out of Report Review
Although some items above are still nol resolved, the subjeci report appears to be accurate. Therefore our
