SUBJECT: February 26,2010 White Mesa Mill Discharge Minimization Technology (DMT)
Performance Standard Moniloring Report, and CeU 4A BAT Perfonnance
Standards Monitoring Repon for the 4th Quarter, 2009, Submitted as a Single
Volume; April 7, 2009 DRC NOTICE OF NONCOMPLIANCE [NONC]; Future
DMT Compliance Detemiination and Report Approval
We received the subject DMT and Cell 4A BAT Reports for the 4th Quarter, 2009, dated February
26, 2010. These two reports were submjtted as a single bound volume, as well as an electronic
copy on compact disk. We have reviewed this information, and note the following:
1. The subject volume contains a summary of the 2009 Cell 2 slimes drain monthly head
measurement tests (>90 hour fluid recovery). It appears the previous items of concerned
raised in the subjeci DRC letter of April 7, 2009 are in compliance in the subjeci report,
with respect to the ground water discharge permit. Therefore, this quarterly report is
hereby approved.
2. The volume contains a DUSA Memorandum dated June 25, 2009 with enclosures
regarding Cell 1 Liner Repairs, which were not included in previous DMT Reports. This
repair report takes up the majority of the subject report volume. The repair report was
submitted earlier by DUSA in an email dated June 26, 2009.
3. As you are aware as required by the Part l.D.3.b.l ofthe permit, "the Permittee shall at all
times maintain the average wastewateV head in the slimes drain access pipe to be as low as
reasonably achievable in each tailings disposal cell, in accordance with a DMT Monitoring
Plan. Compliance shall be achieved when the average annual wastewater recovery
elevation in the slimes drain access pipe, determined pursuant to the currently approved
DMT Monitoring Plan, meets the conditions in Equation 1 . . ." We note that pursuant to
