SUBJECT: June 1, 2009 'White Mesa Mill Discharge Minimization Technology (DMT)
Performance Standard Monitoring Report, 1st Quarter, 2009; April 6, 2009 DRC
Letter: NOTICE OF NONCOMPLIANCE [NONC], Upcoming Permit
Modifications and Potential for Future Enforcement Action; Report Approval
We received the subject 1st Quarter, 2009 DMT report by email on June 1, 2009. We have
reviewed the report, and have the following comments:
1. In section 3.0 of the report, the second paragraph reference should be revised to open with,
"InPart l.E.7b)...."
2. The items of concem raised in our April 6, 2009 NONC letter appear to be complied with
in the subject June 1, 2009 report.
Please include the reference in comment 1 above, in future reports.
In the subject report DUSA noted:
a. On the February 2009 monthly head measurement test form entry for February 27,
2009 that, "Found Discharge pipe to be clogged with Buildup of Solids."
b. On the March 2009 monthly head measurement test form entry for March 28, 2009
that, "We've been having some problems with the Slimes Drain pump. We've placed
a new pump in their And it didn't seem to work, pulled that pump. Conducted Monthly
Recovery test & then placed another pump in the Drain it Seems to be working a little
better, we will keep an eye on it."

We have reviewed the subject report. It appears the items raised in the subject DRC letter of April
6, 2009 have been complied with. Therefore, this quarterly report is hiereby approved.
As you are aware as required by the Part I.D.3.b.l ofthe permit, "the Permittee shall at all times
maintain the average wastewater head in the slimes drain access pipe to be as low as reasonably
achievable in each tailings disposal cell, in accordance with a DMT Monitoring Plan. Compliance
shall be achieved when the average annual wastewater recovery elevation in the slimes drain
access pipe, determined pursuant to the currently approved DMT Monitoring Plan, meets the
conditions in Equation 1 . .." We note that pursuant to Part I.D.3(b) of the upcoming Ground
Water Discharge Permit modification, that Cell 2 compliance in this matter will be determined
after submittal of the 4"' Quarter, 2010 DMT Monitoring Report.
