Director October 1, 2024 Robert Allen Oak Haven Water Company 1121 N Willow Midway, UT 84049 Subject: Notice of Violation – Oak Haven Water Company – UTAH26043 Robert Allen: According to the Division of Drinking Water’s (the Division) records, the Arsenic Treatment Facility (TP003) is violation of the arsenic Maximum Contaminant Level (MCL) of 0.01mg/L. The water system must issue public notice to all connections served within 30 days of receiving this letter, and begin working to reduce the arsenic concentrations leaving the Arsenic Treatment Facility (TP003). Fifty (50) IPS points have been assigned to the system following this violation. Pursuant to Utah Administrative Code (UAC) R309-205-5(1)(i), compliance with the arsenic standard is based off the running annual average of sample results at a facility. The running annual average at the Arsenic Treatment Facility (TP003) is currently 0.011mg/L. This was determined after the most recent arsenic sample collected on August 29, 2024, detected arsenic at 0.0325mg/L. Community water systems which have greater than 150 IPS points are at risk of being rated as “unapproved”. Oak Haven Water Company currently has 85 IPS points. An additional fifty (50) IPS points will be assigned each month that the running annual average exceeds the MCL. With the Arsenic Treatment Facility (TP003) containing arsenic levels above the MCL, you must: 1. Notify all connections served per the attached public notice protocol within 30 days of receiving this letter and repeat the notice every three months for as long as the violation exists. A copy of the public notice must be submitted to the Division at dbkruse@utah.gov by October 24th, 2024. 2. Enact one of the following mitigation measures: a. Identify operational strategies that can minimize arsenic exposure Robert Allen Page 2 of 2 October 1, 2024 b. Identify possible alternative sources of drinking water c. Implement an operation plan to minimize arsenic exposure of the drinking water 3. Present MCL exceedance in annual CCR while including the standard health effects language listed in UAC R309-220-15 for arsenic. Additionally the CCR should include details on the corrective actions being taken. Please be aware that any permanent treatment option must comply with the Division’s plan review process including submittal of design, engineering plans and specification, and obtaining plan approval (prior to construction) and an operating permit (prior to placing into service).
