Pheasant Run Outfitters promptly notified the Director after receiving the IO in 2023 that they were experiencing issues securing water rights. They indicated that they would have to cease operations entirely if those were not resolved. The Director agreed to allow the system additional time to address their water rights. In August of 2024, Pheasant Run Outfitters notified the Director that they intended to continue operations. The Director is issuing the attached amended Enforcement Order Schedule to allow the Pheasant Run Outfitters additional time to comply with the October 2023 IO. The October 2023 IO remains a final order. Pheasant Run Outfitters will remain unrated. Please continue to work with Division staff and your local health department to remain in compliance. Under Utah law, the Director of the Division is required to provide notice of violations of the Utah Safe Drinking Water Act (the “Act”), the rules, or orders and to otherwise enforce compliance with regulatory requirements; this includes violations of the IO.
