The State Painting site (“Site”) is located in West Valley City, Salt Lake County, Utah and
encompasses 83 acres of land owned by West Valley City (WVC) Parks and Recreation. This
land is adjacent to the inoperative industrial painting company known as State Painting LLC. In
2018 the EPA conducted a Removal Action at the State Painting LLC property to dispose of soils
contaminated with hexavalent chromium as well as numerous abandoned containers and drums
left on site. During Removal operations, sediment sampling discovered elevated levels of arsenic
contamination in a nearby WVC stormwater retention pond. The concentrations of arsenic in the
pond were higher than those found on the State Painting LLC property, suggesting the possibility
of an off-site source and the need for further investigation.
In 2023, The Utah Department of Environmental Quality (UDEQ) conducted a Site Inspection
(SI) to investigate the source of arsenic contamination at the Site. Through additional soil and
surface water sampling, it was determined that the likely source of contamination was from
urban and rural stormwater runoff that had been transported to the pond and accumulated in the
sediments over time. WVC intends to implement controls measures to limit public access to
contaminated pond sediments as part of the West Valley Wetlands Park Master Plan. Samples
from other surface water bodies on Site were not significantly elevated for arsenic and there are
no surface water drinking water intakes present. Soil samples collected from the Site contained
relatively low arsenic concentrations, slightly exceeding the Regional Screening levels, which is
not uncommon in Utah soils. There are no residential properties or schools within 200 feet of the
Site. Public groundwater sources within four miles of the Site are routinely monitored for metals
and have a history of compliance with the drinking water standards.
Based on a review of the SI report, the U.S. Environmental Protection Agency (EPA) has
determined that no further remedial action by the Federal Superfund program is warranted at the
referenced site, at this time. The basis for the no further remedial action planned (NFRAP)

determination is provided above. A NFRAP designation means that no additional remedial steps
under the Federal Superfund program will be taken at the site unless new information warranting
further Superfund consideration or conditions not previously known to EPA regarding the site are
disclosed. In accordance with EPA's decision regarding the tracking of NFRAP sites, the
referenced site may be removed from EPA’s Active site inventory and placed in a separate
Archive site inventory as an historical record if no further Superfund interest is warranted.
Archived sites may be returned to the Active site inventory if new information necessitating further
Superfund consideration is discovered.
