This Temporary Exception Expires on December 31, 2029.
Dear Dennis Sorensen:
On October 21, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-515-7(7)(e) regarding fencing around the Parker South Spring (WS002).
According to this rule, spring collection areas shall be enclosed with a stock tight fence.
Greenwich Water Association’s Parker South Spring has been assessed deficiency SS02 for not having a stock tight fence surrounding the Spring collection area. To the best of the operator’s
knowledge, the Parker South Spring has never had a fence around the collection area. The Parker South Spring is located in a remote canyon east of Greenwich on Bureau of Land Management
property. The spring is mostly surrounded by steep grades, which would make it difficult to construct a fence around the spring collection area. Cattle grazing is also not allowed in
the area where the spring is located.
Exception Request
The basis for your request for an exception to R309-515-7(7)(e) is that the steep terrain surrounding the spring would make it difficult to construct a fence and cattle are not allowed
to graze in this area. You propose to keep the spring box access hatch locked at all times and monitor the area regularly to ensure the spring area has not been damaged or tampered with.
On this basis, an exception to R309-515-7(7)(e), Spring Development (fencing), is hereby granted for the Parker South Spring (WS002).
This Temporary Exception expires on December 31, 2029.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to December 31, 2029.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by December 31, 2029, will result in the activation of the deficiency related to not having a stock
tight fence around the spring collection area.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.The issuance of this exception temporarily resolves your water system’s deficiency related to not having a fence around the Parker South Spring collection area. An updated
IPS report isavailable at https://waterlink.utah.gov. Please contact Jennifer Yee at (385) 515-1501 or jyee@utah.gov for questions related to your water system’s IPS report or deficiencies.
