Re: Warning Letter - Mountain View Mushrooms, Approval Order (AO) DAQF.-1027-92, dated
October 29,1992, Millard County, Utah
On December 19, 2023,the Utah Division of Air Quality (DAQ) issued a Compliance Advisory
(DAQC-1348-23) to Mountain View Mushrooms at 550 South 1100 West in Fillmore, Utah due
to the observation of an emergency boiler operating as the primary boiler for non-emergency
purposes. The DAQ believes that Mountain View Mushrooms was in violation of Condition 28 of
the AO. On August 23,2024, Mountain View Mushrooms submitted a Notice of Intent to address
the issue and update the AO. On October 1,2024, the source confirmed the boiler has only
operated on natural gas for the previous two years.
Please be aware this letter is a warning and that future instances of noncompliance may be
considered violations of Condition 28 of the AO and Mountain View Mushrooms may be
assessed penalties up to $10,000 per day if found to be in violation of Utah Air Quality Rules. If
this warning is related to a requirement involving submitting a Notice of lntent to the director to
update or receive an Approval Order under Utah Administrative Code R307-401-5, the DAQ
retains its authority to take subsequent enforcement action if during the next inspection the DAQ
finds the source is still not in compliance with R307-401-5.
