Dear Mr. Sachs:

On October 30, 2023, the Division of Environmental Response and Remediation (DERR)
issued an Additional Sampling Requirements Following Site Closure Review, Compliance
Schedule (Compliance Schedule) to you, which outlined information required to be submitted to
the State of Utah concerning your above-referenced Release Site. The required information has not
been submitted and is currently past due.
Pursuant to Utah Admin. Code R311-202, Sections 280.62 through 280.65, Moyle
Petroleum Company is required to further characterize the site by determining the extent and degree
of petroleum contaminated soils and groundwater. The report(s) associated with these requirements
(outlined in the Compliance Schedule) was due on February 27, 2024.

After December 31, 1995, any petroleum storage tank (PST) release management,
abatement, investigation or corrective action must be performed by a Certified PST Consultant as
outlined in Utah Admin. Code R311-201-2. Failure to submit the required report(s) referenced
herein within 60 days of your receipt of this notice may result in further compliance actions against
you.
