COX Governor DEIDRE HENDERSON Lieutenant Governor DAQC-989-24 Site 14346 (B1) Jeffery Cowlishaw Staker Parson Companies 2350 South 1900 West Ogden, Utah 84401 Dear Mr. Cowlishaw: Re: Staker Parson Companies – Temporary Relocation/Operation, Notice of Intent – Duchesne County Your Notice of Intent dated September 30, 2024, to relocate portable aggregate equipment to the temporary project for Staker Parson Companies’ Todd Moon Facility, located 1.7 miles north bound on Nine Mile Road, turning right and then another 1.7 miles to the left side of the road, near Myton, Utah was received by the Utah Division of Air Quality (DAQ) and has been reviewed. The following equipment has been approved for operation for this temporary project: KPI-JCI 500TPH track crusher with 328 kW diesel engine KPI-JCI 500 TPH track crusher with 328 kW diesel engine The above equipment has been permitted for operation in the State of Utah by the portable AO DAQE-AN132670009-21 dated April 7, 2021. The relocation address is a permitted facility with established conditions. All equipment operating at this site must be in accordance with the current Approval Order (AO) for this site DAQE-AN0143460001-11 dated May 18, 2011. The total production of aggregate from all temporary projects when combined with the permanent equipment’s production cannot exceed the 12-month rolling limits as per Condition II.B.1.b of this AO. The use of the diesel engines when combined with the operation of the 900-kW diesel generator shall not exceed the 12-month rolling limit of Condition II.B.3.a. In addition, the ton per hour processing of the relocated track crushers shall be held to the 500 ton per hour design capacity of the equipment. 1 , " / á Û Ù Û Ý DAQC-989-24 Page 2 Approval is granted to relocate and operate this equipment at the new location for a period not to exceed 180 operational days. As per Utah Administrative Code (UAC) R307-401-17, the operation of equipment at this temporary site may be for up to 180 working days in any calendar year not to exceed 365 consecutive days, starting from the initial relocation date. The operational days per site cannot be extended beyond the stipulated 365 consecutive day period. The owner/operator shall maintain records of the actual operation hours, days, and production rate, of the above referenced equipment at this relocation site and have the ability to submit the information to the DAQ upon the request of representatives of the Director. Please make certain that the plant operator is aware of all the location specific requirements for this site and the conditions of the aforementioned AO. Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary project. Please refer to Utah DEQ Water Quality’s current Storm Water Construction requirements for additional information. This approval for relocation in no way releases the owner or operator from any liability for compliance with all other applicable federal, state and local regulations including the UAC.
