This Temporary Exception Expires on October 31, 2027.
Dear Max Covey:
On October 1, 2024, the Division of Drinking Water (the Division) received your request for a renewal of the Temporary Exception issued on September 28, 2021 to Rule R309-550-9(2) regarding
recycled water at five of your facilities. According to this rule, neither steam condensate nor cooling water from engine jackets or other heat exchange devices shall be returned to
the potable water supply.
During the 2021 sanitary survey, HVAC cooling systems were identified at Lower Deer Crest (PF003), Mid Deer Crest (PF004), Upper Deer Crest (PF005) and 248 Tuhaye Ranch (PF009) Pump
Facilities and Victory Ranch Well #1 (WS006), which all use drinking water from the suction side piping to provide a cooling liquid to the HVAC cooling system and recycle the water back
into the discharge piping. A fan blows air over the cooling coil to provide cooling for the interior of the building and facilities.
Exception Request
The basis for your request for an exception to R309-550-9(2), Recycled Water is summarized below:
The cooling system is a closed-looped system of a circulation pump, piping and copper pipe coils. There is no possibility of cross contamination in the system.
Recycling the water avoids the wastage of water on an on-going basis.
The cooling system is significantly more energy efficient than a standard air conditioning unit. No additional public health benefit would be achieved from the cost of retrofitting the
system to use an alternative approach.
Rob Kessler, mechanical design engineer with Heath Engineering, provided confirmation that this cooling system was specified and constructed with NSF61 certified components including
copper piping, valves, pumps, and cooling coil.
Additional copper sampling was required in 2022 which has been completed and demonstrated satisfactory results.
Temporary Exception to R309-550-9(2)
On this basis, a Temporary Exception to R309-550-9(2), Recycled Water for Lower Deer Crest (PF003), Mid Deer Crest (PF004), Upper Deer Crest (PF005) and 248 Tuhaye Ranch (PF009) Pump
Facilities and Victory Ranch Well #1 (WS006), is hereby granted with the following conditions:
This Temporary Exception expires on October 31, 2027.
Continue to comply with all Monitoring and Reporting requirements for your system.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to October 31, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by October 31, 2027, will result in the activation of the deficiency related to recycling cooling
system water.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.
The issuance of this exception temporarily resolves your water system’s deficiencies for having an unprotected cross connection at the referenced facilities (PF003, PF004, PF005, PF009,
WS006). An updated IPS report is available at https://waterlink.utah.gov. Please contact Jennifer Yee at (385) 515 1501 or jyee@utah.gov for questions related to your water system’s
IPS report or deficiencies.
Please maintain a copy of this letter with your permanent records for future reference.
