Re: Staker Parson Companies – Modification to DAQC-532-24 Temporary Relocation –
Correction to Asphalt Plant Manufacturer Reference – Kane County
Your request dated September 24, 2024, to change the manufacturer reference for the asphalt
plant operating at the temporary project located at 0.5 miles north of Highway 89 on Ethan Alan
Street, Big Water, UT, was received by the Utah Division of Air Quality (DAQ) and has been
reviewed.
The following equipment has now been approved for operation for this temporary project:
BMG 400 TPH asphalt plant
Associated asphalt support equipment
1000 hp generator
The referenced asphalt plant has been permitted for operation in the State of Utah by the portable
Western Rock Products Approval Order (AO) DAQE-AN0117960008-07, dated July 26, 2007.
The referenced generator has been permitted by the Staker and Parson Companies AO
DAQE-AN115180014-15, dated July 6, 2015. Approval is granted to relocate and operate this
equipment at the new location for a period not to exceed 180 operational days. As per Utah
Administrative Code (UAC) R307-401-17, the operation of equipment at this temporary site may
be for up to 180 working days in any calendar year not to exceed 365 consecutive days, starting
from the initial relocation date. Conditions 20, 22, and 26 of the Western Rock Products AO
permitting the asphalt plant establishes the stack testing requirements of this equipment. As per
Condition 26.B, this plant must stack test within 180 days of starting operations at this location.
The procedures stated in 26.F must be followed if the maximum AO allowable production rate
has not been achieved at the time of the test. It is important to be aware that as per Condition
26.C, a testing protocol shall be submitted to the DAQ for review and approval at least 30 days
prior to conducting the stack test.

Approval is subject to the conditions of the dust control plan submitted for this location and the
applicable conditions of the above referenced AOs. Hours of operation shall be held to 16 hours
per 24-hour day. Condition 16 of the referenced AO requires that the operating hours of this
equipment must be from 6:00 am to 10:00 pm. The maximum production rate shall be held to the
requested 350 tons per hour. Emissions for this project have been estimated at the following:

The owner/operator shall maintain records of the actual operation hours, days, and production
rate, of the above referenced equipment at this relocation site and have the ability to submit the
information to the DAQ upon the request of representatives of the Director. Please make certain
that the plant operator is aware of all the location specific requirements for this site and the
conditions of the aforementioned AO.
Utah Division of Water Quality Storm Water Permits and regulations may apply to this
temporary project. Please refer to Utah DEQ Water Quality’s current Storm Water construction
requirements for additional information.
This approval for relocation in no way releases the owner or operator from any liability for
compliance with all other applicable federal, state, and local regulations including the UAC.

Susan,
As per our call this morning, would you be able to modify this TRP to reflect that the plant is a BMG instead
of an Astec? I’m onsite completing your requested stack test currently, and I noticed that the TRP doesn’t
line up with the plant manufacturer. The test protocol mentions the plant as a BMG, and I want to make sure
there’s no confusion with which plant was tested in the future.

Your Notice of Intent dated May 16, 2024, to relocate portable asphalt equipment to the
temporary project located at 0.5 miles north of Highway 89 on Ethan Alan Street, Big Water,
Utah, was received by the Utah Division of Air Quality (DAQ) and has been reviewed.
The following equipment has been approved for operation for this temporary project:
Astec 400 TPH asphalt plant
Associated asphalt support equipment
1000 hp generator
The referenced asphalt plant has been permitted for operation in the State of Utah by the portable

Regarding this temp relo, I had some questions I hope you could answer. First: can submitted temp relo applications be
modified once they’re paid for and submitted to you, or do I need to submit a new application, FDCP, and fee?
Next, I was going through my records and came across a portable AO for Western Rock that doesn’t show up on the
UDAQ NSR page. It seems to cover the same equipment with the same serial numbers as DAQE-209-96. The permit
number is DAQE-AN1796008-04. Is this active? If so, it would be easier to use.
Next, does the DAQ require stack test results for all temp relos, or just plants that you don’t have record of having a test
within a certain time frame?
Thanks for all your help. I am excited to get this finalized and submitted.

Hello, the DAQ currently requires verification that relocated asphalt plants have performed the required stack tests prior to
authorizing the operation at a new location. We have 2022 pre-test records for this plant, but we do not have
documentation that the test actually occurred on the scheduled date.
Can you provide us with the stack testing results? Thanks, let me know if you have any questions.

As confirming what was said in our phone conversation, we would instead like to use AO DAQE-AN1796008-04 on this
project. To the best of my understanding there is no applicable AO for the relocation site. We are aware that, depending
on production percentage of plant max capacity, we may have to have a stack test within 180 days of starting production,
of which I will notify you of at least 30 days before the test.

Hello, as stated during this morning's phone call, the relocation letter authorizing the asphalt plant equipment has been
submitted for my management's signature. The asphalt plant will be required to test within 180 days of the operation.
Even though the full design capacity of this plant may not be achieved during this temporary project, the plant will be
required to test as per the procedures of Condition 26.F of the attached portable Western Rock Products AO. A more
recent 2007 update to the 2004 AO you referenced on your last email was found, see the attached .
Also, Condition 16 of this AO requires that the referenced portable equipment be operated between the hours of 6:00 am
to 10:00 pm, rather than Staker's requested 5:00 am through 9:00 pm.
