County
Your Notice of Intent dated September 10, 2024, to relocate portable asphalt and crushing
equipment to the temporary project located north on UT-87 from Main Street in Duchesne for 1.2
miles, turning east on 8300 South, Duchesne County, UT, was received by the Utah Division of
Air Quality (DAQ) and has been reviewed.
The following equipment has been approved for operation for this temporary project:
Gencor hot mix plant
Pioneer 500 TPH jaw crusher
Two (2) JCI 500 TPH cone crushers
Three (3) 7x20 screens
Kohler 810 kW generator
Whisperwatt 40 kW generator
Caterpillar 3508 kW generator
This equipment has been permitted for portable operation in the State of Utah by the portable
Approval Order (AO) DAQE-AN132670009-21, dated April 7, 2021. Approval is granted to
relocate and operate this equipment at the new location for a period not to exceed 180 operational
days. As per Utah Administrative Code (UAC) R307-401-17, the operation of equipment at this
temporary site may be for up to 180 working days in any calendar year not to exceed 365
consecutive days, starting from the initial relocation date. Approval is subject to the conditions of
the dust control plan submitted for this location and the above portable AO.

Hours of operation for this equipment shall be held to 16 hours each day. The maximum
production rate for aggregate production shall be held to the requested 500 tons per hour.
Emissions for the aggregate portion of this project have been estimated at the following:

As per State Administrative Rule R307-165-4, the production rate for the asphalt plant shall be
held to 110% of the production rate of the last successful stack test for this plant, which is 194
tons per hour. Emissions for the asphalt production portion of this project have been estimated at
the following:

Please be aware that the State of Utah requires that your company’s permitted asphalt plants must
be tested every three years or sooner if required by the Director. The stack test shall be conducted
as per the applicable conditions of the above portable AO. A stack testing protocol must be
submitted to the DAQ at least 30 days prior to the performance of the test.
The owner/operator shall maintain records of the actual operation hours, days, and production
rate, of the above referenced equipment at this relocation site and have the ability to submit the
information to the DAQ upon the request of representatives of the Director. Please make certain
that the plant operator is aware of all the location specific requirements for this site and the
conditions of the aforementioned AO.
Federal New Source Performance Standards Subpart OOO requires that initial Method 9
observations be performed for all applicable portable crushers, screens, and attached conveyors.
Subpart OOO also mandates that all crushers constructed, modified, or reconstructed on or after
April 22, 2008, which are not enclosed, must install spray bars on the equipment and keep
maintenance records to ensure proper spray bar operations.
Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary
project. Please refer to Utah DEQ Water Quality’s current Storm Water Construction
requirements for additional information.

This approval for relocation in no way releases the owner or operator from any liability for
compliance with all other applicable federal, state, and local regulations including the UAC.

Thanks, Kyle. I appreciate it. A quick look at the stack test looks like everything is good but I look forward to hearing what
you think.
Susan - I see you submitted this Temporary Relocation Letter yesterday morning. I am going to cancel it because they
have listed their production rate at 500 TPH. This is going to be fine for the aggregate side but they have also noted the
design capacity of the hot mix plant at 400 TPH. However, the stack test they submitted indicates the actual production
rate at the time of testing was 177 TPH. Per R307-165-4, they are not going to be able to run this hot plant beyond 110%
(194 TPH) of this tested production rate for the duration of this project unless they want to do a new stack test. Please let
Jeffery know this and update the TRP letter to include this information.

sent them an acceptance letter on April 10, 2021. It looks like they didn't actually stack test until 2023 and this report

I submitted a TRP for Staker Parson moving aggregate and asphalt equipment to Duchesne yesterday. I asked
Jeffery Cowlishaw to submit the most recent stack test information if he had it. The TRP Letter that I sent in has the
standard language regarding stack testing. Let me know if this test that was performed in October of 2023 (see the

Hello, I've reviewed the September 10th electronic submission for the Main Street in Duchesne asphalt project. Your
reported distance to the nearest house or business is 875 feet which is really close for an asphalt project. Can you
give me more information about what this referenced house or business is? Also, can you let me know if the asphalt

I can't find any relocations using that Approval Order. The most recent document issued for this permit was a stack
test review of a test performed on March 9, 2022. If the relocation project is still active you can submit it now and
I'll let Chad know that you have had a change in personnel.

north of Duchesne city. I think it may have been submitted right around the time that a couple of our
employees left and we don’t have record of it. The application may have been submitted and the approval

Hello, the relocation for the aggregate and asphalt equipment was submitted for Chad's signature last Monday. It looks
like the asphalt stack test has been reviewed and will be approved. However, the asphalt plant was running at 177 TPH
during the test. The language of R307-165-4 allows asphalt plants to operate at 110% of the most recent test. Because of
this, I've been asked to modify the authorized production rate for the asphalt plant to be 194.
