Temporary Exceptions No Longer Required to Rules R309-600-13(3) and R309-515-6(4) for sewer infrastructure in source protection zone two; Jones Hole National Fish Hatchery; Water System

Dear Travis E. Anderson:
The Division of Drinking Water (the Division) has not received an updated Drinking Water Source Protection (DWSP) plan for the Jones Hole Fish Hatchery Springs, which was due by December
31, 2023.
According to R309-600-7(2)(e), each public water system shall update its DWSP Plans as often as necessary to ensure they show current conditions in the DWSP zones and management areas.
DWSP Plans are initially due according to the schedule in R309-600-3. Thereafter, updated DWSP Plans are due every six years from their original due date. Updated DWSP plans must document
the implementation of land management strategies in the recordkeeping section. Actual copies of any ordinances, codes, permits, memoranda of understanding, public education programs,
bill stuffers, newsletters, training session agendas, minutes of meetings, memoranda for file, etc. must be submitted with the recordkeeping section of your updated plans.
Guidance for preparing an updated plan can be obtained from the Division website at
https://deq.utah.gov/drinking-water/preparing-source-protection-plans, or you may contact Deidre Beck, of this office, at (385) 271-7046 or via email at dbeck@utah.gov, to request a
copy of the guidance.
A dormant deficiency (SP04 ACTIVE SOURCE LACKS APPROVED UPDATES TO DWSP) has been added to the Division’s database to serve as a tracking tool and reminder. Failure to correct this deficiency
by the required due date (90 days from the date of this letter) will result in 5 Improvement Priority System (IPS) points being assigned. If you have any questions about these points,

Please also be aware that the Division recently revised rules R309-600-13(3) - Sewers Within DWSP Zone One and R309-515-6(4) - Source Protection to remove the special construction requirements
for sewer infrastructure located in source protection zone two. According to our records, exceptions to these rules were granted for the Jones Hole Fish Hatchery Springs for existing
sewer infrastructure located within zones one and two. Temporary exceptions to these rules, and any conditions previously identified to comply for the sewer infrastructure within source
protection zone two, are no longer required. A copy of the letter identifying the conditions is attached.
The system must still comply with the conditions identified for the existing sewer infrastructure located within source protection zone one (100-feet radius around the source).Please
