Subject:Concurrence, Updated Drinking Water Source Protection Plan for Well #1; Hyrum City; Water System #03008, Source No. WS003
Dear Kade Elwood Maughan:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for Well #1 from your consultant, Darin Hawkes with AQUA Engineering,
on November 23, 2022. The Division requested additional information via email on April 22 and August 22, 2024. The Division received a revised update from your consultant on September
6, 2024.
We have completed our review of the updated DWSP plan and find that the plan basically complies with the applicable portions of Utah’s Administrative Rules for Public Drinking Water
Systems. The Division concurs with this updated plan. We commend you for establishing a program to protect this source from present and future contamination. This plan must be updated
often enough to ensure that it reflects current conditions in your protection zones.
The due date for submitting the next updated plan for wells is December 31, 2026.RemindersAs stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System (PWS) shall
begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal if the plan is not disapproved. Be prepared to describe these
efforts in your next update, which should include documentation of how the land management strategies identified for existing and future potential contamination sources were implemented.
Your updated plan will be disapproved, and 25 Improvement Priority System (IPS) points will be assigned for failure to comply with this requirement.As stated in R309-600 and 605: Recordkeeping
- As a DWSP Plan is executed, the PWS shall document any land management strategies that are implemented. Please provide actual copies of memoranda of understanding, public education
programs, bill stuffers, newsletters, or other correspondence documenting the implementation of each land management strategy as it occurs, in this section of your updated plan.
Monitoring Reduction Waivers
You requested susceptibility waivers for volatile organic contaminants (VOCs) and/or pesticides. Well #1 (WS003) is not eligible for susceptibility waivers due to a lack of evidence
for protected aquifer conditions. Therefore, the requirements of R309-600-16(4) have not been met.
Well #1 (WS003) was originally approved for a use waiver for VOCs and/or pesticides. This source is not eligible for a use waiver due to urban development within the protection zones
one, two, and three. Therefore, the requirements of R309-600-16(3) have not been met.
Increased Monitoring Requirements
The use waiver for Well #1 (WS003) has been revoked and pesticide monitoring is now required. Pursuant to R309-205-6, community water systems serving a population greater than 3300 shall
collect pesticide samples each quarter that the source provides water to the distribution system. Following four quarters of sampling, if there have been no pesticides detected, the
source will qualify for a reduced monitoring schedule in which two pesticide samples will be required every three years. Additionally, Well #1 is now required to be sampled for volatile
organics once every three years.
The next pesticide sample is due sometime between October 1, 2024, and December 31, 2024. The Next volatile organics sample is due sometime between January 1, 2023, and December 31,
2025.

Please see the attached monitoring schedule for your current required sampling. Use and susceptibility waivers must be renewed every six years with your updated source protection plan,
