Enclosed is Emergency Permit #UT-002-2024authorizing Tooele Army Depot - North Area to treat 141 compromised High Explosive 3.5 inch Rochets via open detonation. During an inspection,
the rockets were suspended due to the possibility that unstable Cupric Azide compounds may have formed in the fuses. The Air National Guard Explosive Ordinance Disposal (EOD) determined
the rockets were unsafe to store or transport. Ultimately, EOD determined the safest means of disposal would be to detonate the rockets near the storage igloo.This permit was effective
and expired on the dates specified in the permit and is issued under the authority of the Utah Solid and Hazardous Waste Act and R315-270-61 of the Utah Administrative Code.If you have

Pursuant to the Utah Solid and Hazardous Waste Act, Utah Code §19-6-101, et. seq., as amended, and the Utah Administrative Code (UAC R315-260 through R315-270 and R315-124), the Director
of the Division ofWaste Management and Radiation Control (Director), based on representations by the Tooele Army Depot - North Area (hereafter called the “Permittee”), found the described
circumstances potentially posed an imminent and substantial endangerment to human health or the environment and, therefore, issued an oral temporary emergency permit and is now followed
by this emergency permit (Permit),to treat 141 compromised High Explosive 3.5 inch Rochets via open detonation. During an inspection, the rockets were suspended due to the possibility
that unstable Cupric Azide compounds may have formed in the fuses. The Air National Guard Explosive Ordinance Disposal (EOD) determined the rockets were unsafe to store or transport.
Ultimately, EOD determined the safest means of disposal would be to detonate the rockets near the storage igloo.
The Director’s issuance of such Permit is also authorized under Section 3006(b) of the Resource Conservation and Recovery Act (42 U.S.C. §6926(b).The Permittee shall comply with all
terms and conditions of this Permit. ThisPermit consists of the applicable portions of UAC R315-260 through 263,R315-124, and R315-101. Additionally, to the extent possible and not
inconsistent with the imminent and substantial endangerment, this Permit also incorporates, applicable requirements of UAC R315-270, R315-264, and R315-266. Applicable rules are those
that are in effect on the date of issuance of this permit. The Director’s decision to issue an oral emergency permit, followed by this temporary emergency permit, is wholly dependent
upon the premise that the information received verbally on January 29, 2024, in an email received February 1, 2024, and in the written request dated February 5, 2024 (DSHW-2024-004558)
is accurate and the treatment will be conducted as specified therein. Any inaccuracies or misrepresentations found in the request described above may be grounds for termination of this
Permit, in accordance with UAC R315-270-61(b)(4), and possible enforcement action. The Permittee shall immediately inform the Director of any deviation from, or changes in, the information
in the request which would affect the Permittee's ability to comply with the applicable regulations.This Permit is effective February 12, 2024 and expires March 1, 2024, unless terminated
