Also, just t o be sure y ou and y our c lient are aware of this , a bonafide pers pec tive purc haser defens e is no longer
applic able after t he buyer has closed on the property. Once they close on t he property they are ineligible for an EW A,
that's why I was mentioning bac k up plans or ex tens ions .

Hi Michael,
Just following up with various discussions I have had with Leigh. I understand there is a desire to close on the property,
perhaps this week. If your client needs to close, that's ultimately their business decision and they have the right to
terminate the EWA application and assert their own federal defense. As you know, we don't issue EWAs after a party has
closed. I did notify you in the beginning that our time would be between 45/60 days (application received July 16). I am
just making sure the timing is clear. Additionally, I believe she is still waiting on a few items, such as the Owner
interview, so the Phase I can be considered complete and AAI compliant. It is also important that the Phase I User and
EWA applicant are the same (or have reliance). Finally, I believe she indicated that some of the Class B/C material had
been managed under the roadways and this was not noted, yet important. Please continue to have your technical team
work with Leigh. We need to meet AAI and the Evaluation Principles before we can recommend an EWA.

Unders tood. I believe the only thing we are waiting on is the interview with the owner, whic h we should have shortly. Are

I will defer to Leigh, but typically, yes, that's a material fact that is often noted in technical documents, such as a Phase I
for acquisition. Leigh, please weigh in tomorrow and provide feedback for the customer.

There is a bit of the information about the c urrent borrow material loc ation on t he pages I mentioned (I think 32 33 and
818), but yes, including it in the c onclus ions would be a very good idea. The VCP's COC and old Sit e Management Plan,
whic h are what the c onclusions c urrently refer to, doesn't ac tually have t his newes t informat ion in it.
