SUBJECT: No Further Action Leaking Petroleum Storage Tank - Closure Review Memo
Maverik #314 located at 795 South State Street, Orem, Utah
Facility Identification No. 1000317, Release Site OIS
A petroleum release from an underground pipe was reported to the Division of Environmental Response
and Remediation (DERR) on September 6, 2024. The release was reported to the DERR based on a
failed line tightness test. The extent and degree of contamination has been fully defined and a No Further
Action (NFA) review is hereby requested.
Due to residual contamination that is to remain in place, this release was discussed at Closure
Committee on August 21, 2024. In this meeting it was decided that the DERR will utilize Blue Stakes
of Utah and create a contamination map to supplement the NFA letter to alert excavators who may
work in the area.

Maverik #314 located at 795 South State Street, Orem
Facility 1000317 Release OIS
Site Overview:
This site is an active Maverik gas station in Orem. At some point in the three week period from
August 16, 2023 through September 6, 2023 there was a release of gasoline to the soil. It is
unknown how much fuel was released or when it started but Inventory Reconciliation Reports
determined that it was likely around 85 gallons. The release was caused by a corroded flexible
pipe connection and occurred directly under dispenser 1/2. When internal alarms signaled on
September 6, the line was immediately shut off for repairs.
Initial abatement for the release was conducted on September 13, 2023. 2290 lbs of soil was
excavated from below dispenser 1/2 and taken for proper disposal at the Sump and Trap
Cleaning Facility in Salt Lake. Four confirmation samples were collected, 3 of which contained
petroleum constituents above Tier 1 Screening Levels. Since the release occurred directly under
the dispenser, clean up was limited due to concerns of the dispenser collapsing into the
excavation. As much soil as possible was removed with hand tools but some was left in place.
The dispenser would need to be removed in order to excavate any further.
A subsurface investigation was conducted on December 22, 2023. However, the two soil borings
(B-1 and B-2) were not drilled in the locations originally proposed because the boom height of
the drill rig was too high to drill under the canopy and adjacent to the dispenser as planned.
On May 29, 2024 a soil auger was used to collect one additional soil sample (B-3) 10 feet from
dispenser 1/2.
None of the samples collected contained petroleum constituents above Initial Screening Levels.
A previous subsurface investigation at this site determined groundwater was at a depth of 70 feet
below the ground surface (bgs). Water Right 55-321 is located 815 feet away. The site is located
within groundwater protection zone 3.
Due to the degree of contamination that will be left in place, the site will be added to Blue Stakes
of Utah and a contamination map will be developed to alert construction personnel of the
contamination.
Nature and Extent of Contamination:
The broken pipe connection was located at 4.5 feet bgs.Confirmation samples were taken at the
time of initial abatement and labeled SS-1 through SS-4.
Samples taken at 4.5 (SS-1)and 5 (SS-2)feet bgs directly underneath the pipe contained high
concentrations of BTEX and TPH-GRO.SS-3 was collected approximately 3 feet northwest of
the broken pipe at 4.5 feet bgs,while the concentrations of BTEX and TPH-GRO are still high,
they are significantly less than directly below the pipe.SS-4 was collected 3 feet to the southeast
and at 4.5 feet bgs and did not contain any petroleum constituents above ISLs.
To explain further,SS-2 contained 6.99 ppm benzene,SS-3 contained 0.42 ppm benzene and
SS-4 contained <0.11 ppm benzene.
This indicates that the gasoline likely traveled vertically through the soil and did not spread
laterally.6 additional samples from 3 soil boring locations confirm there was no lateral spread of
contamination.
Initial Abatement and Feasibility of Further Remediation
2290 lbs of soil was removed with hand tools as part of the initial abatement of the release.
Further excavation was not possible due to the presence of conduits and the risk of destabilizing
the dispenser.
Due to the contamination being located directly below dispenser 1/2,further remediation is not
economically feasible at this time.To access the residual contamination,the dispenser would
have to be removed.Furthermore,Maverik #314 is located on a very small lot,any remediation
activity would likely require the site to shut down for the time being or lose customers due to
issues entering /leaving the lot.
Since this site is to remain a gas station for many years,it does not make economic sense to
remove the small pocket of contamination at this time.
Exposure Pathways
Soil Leaching to Groundwater
This pathway is incomplete,a previous subsurface investigation conducted in 2009 determined
groundwater was not present until at least 70 feet bgs.Due to the relatively small quantity of the
release,less than 85 gallons,it is unlikely to travel deep enough to encounter groundwater.There
would be more lateral impacts from the release if it was large enough to penetrate over 70 feet of
soil further indicating that the release is localized in a small pocket under the dispenser.Lastly,
the majority of the source material has been removed.
Groundwater Ingestion
This pathway is incomplete.There are no water rights within 500 feet of the release.
Furthermore,drinking water is not sourced from aquifers in the area.
Vapor Intrusion to Indoor Air
This pathway is incomplete.The gas station building is located 33 feet away from the release.
The contamination is located in a small pocket at least 4.5 feet bgs and the soil sample collected
from B-2,which is located between the release and the building,did not contain any petroleum
constituents above ISLs.The contamination is overlain with asphalt which prevents
volatilization.
Vapor Intrusion to Outdoor Air
This pathway is incomplete.The contaminated soil is located at a depth of at least 4.5 feet bgs,
this means that petroleum vapors would likely attenuate through the clean soil before reaching
the surface.The contamination is also overlain with asphalt.
Dermal Contact
This pathway is partially complete.Currently,the contamination is inaccessible as it is located
underneath the dispenser.However,the site will be added to Blue Stakes of Utah to alert
construction personnel of the contamination.A Contamination map for the site will accompany
the NFA.
Recommendation for No Further Action:
This site meets the Corrective Action Cleanup Standards Policy for PST sites at Utah UST Rule
R311-211.Further cleanup of this site is not warranted as the remaining contamination is not
likely to adversely affect human health and the environment as discussed above.The residual
contamination will be mapped and added to Blue Stakes of Utah.
