Before I can concur a few items need to be addressed. 1. The DWSP plan from 2015 was conditionally concurred with on the condition that section 6 management of future PCSs would be revised to include the language bulleted below. This language was not included in the update and therefore the condition has not been met. This language will need to be added before we can concur with this update. State that the water system will monitor for and contact new PCSs as they move into the protection zones. State that the water system will add any new potential contamination sources (PCSs) to the inventoryState that the water system will assess each new PCS as controlled or not State that the water system will plan land management strategies if any new PCS is not adequately controlled2. The update did not provide any recordkeeping documentation showing that the water system implemented land management strategies for the highway or the airport. The system agreed to distribute public education material to both of these uncontrolled PCSs. This should be done at least once every update cycle (six years) to meet the public education requirement. If this has been done since 2015, please confirm and provide dated documentation showing this. If this has not been done, please distribute public education material to these two PCSs as soon as possible. Provide the material that was distributed and the date of distribution in a revised update. Public education can be accomplished by simply including the attached fact sheets in an email or mailer to each uncontrolled PCS. 3. It appears that a golf course is located within the protection zones. Since golf courses typically use fertilizers, this property should be considered as a PCS. Please addthis to the inventory and assess. This PCS may be considered controlled through best management practices if you can confirm with the golf course management thatfertilizers are being applied as directed by the manufacturer.4. This source was approved for susceptibility waivers in 2015. Waivers reduce the required monitoring frequency for volatile organic compounds (VOCs) and pesticides. These waivers only last six years, so the water system needs to renew them with each update cycle. Lack of plan implementation is considered a significant deficiency and could result in 25 Improvement Priority Points being assigned for failure to comply. As a courtesy, I can provide 90 days from the date of this email to address this issue, before I draft a formal disapproval letter. Let me know if there are any questions. Some of the issues were not addressed. Further guidance is below. 1. In section 5, you state that land management strategies were implemented, however, you did not provide copies of the material you distributed. Your original plan states that a letter would be sent to the airport and UDOT. You must provide copies of this material showing that they were distributed in the last update cycle (sixyears). The attached pdf includes the letters that you sent in 2014. Were these letters distributed again in the last update cycle? If not, do the following:Distribute the letters to the airport and to UDOTIn section 7, state that these letters were sent on date mm/dd/yyyy. In section 8, include a copy of the letters. You mentioned backflow/cross-connection info was distributed. That's great, but source protection is more concerned about fuel spills or chemicals leaching into the groundwater from potential contamination sources (PCSs) within your protection zones. The golf course is located within protection zone 4 (see the attached pdf document for confirmation). Since golf courses typically use fertilizers, add the golf course to the inventory and assess. Please do the following: In section 3, state the golf course is in zone four and is a PCS because of likely fertilizer and/or pesticide use. In section 4, state that this PCS is controlled by best management practices if you can confirm that owners apply fertilizer and pesticides in accordance with manufacturer instructions. No management strategies are required if assessed as controlled. Additionally, we typically allow roads to be considered controlled by regulatory controls. If you would like to not implement strategies for the highway, I would suggest you reassess the highway as a controlled PCS through regulatory controls, referencing CFR Title 49 part 130. I want to get this sorted out now so that you will not have to deal with these issues down the road. Once these revisions have been made, you can email a copy of the update directly to me at nzorsky@utah.gov. Let me know if you have questions. I will be able to approve your plan so expect to see a formal concurrence letter in the next few weeks. As we discussed. The Golf course was added as a potential contamination source (PCS) and is considered adequately controlled through best management practices. The highway is now being assessed as adequately controlled through regulatory controls by CFR Title 49 part 130; UDOT's oil spill prevention and response plan. Since these two PCSs are considered adequately controlled, your system is no longer required to distribute public education to the golf course or to UDOT, but you are more than welcome to if you'd like. The airport is still being considered as an inadequately controlled PCS due to the higher risks associated with their day-to-day operations and risk of spills within the protectionzones. Therefore, public education will need to be sent to airport management at least once every six years (update cycle). Records of what was sent to the airport and when must be included in all future updated DWSP plans.
