Box 1339 Grantsville, UT 84029-1339 RE: Extended Response Timeline for Notice of Violation and Compliance Order No. 2402019 UTD981552177 Dear Mr. Simmons: On July 16, 2024, the Division of Waste Management and Radiation Control (Division) received your request for an additional 30 days to respond to Notice of Violation and Compliance Order No. 2402019 (NOV/CO) (DSHW-2024-007366). The Director of the Division hereby grants the extension request, and based on the June 25, 2024, signature date of the NOV/CO, the following response timelines now apply: For Violations 1, 3, 4, 5, 6, 7, and 8, Clean Harbors Aragonite, LLC shall, within 60 days of the signature date of the NOV/CO, submit to the Director a written statement describing the following information in detail: a. The cause of each violation; b. The specific corrective actions taken, results achieved, and applicable dates; c. If future corrective actions are proposed, the specific corrective actions and proposed completion dates, including intermediate milestones, as applicable; and d. How the corrective actions will prevent similar violations from recurring. Clean Harbors Aragonite, LLC shall, within 90 days of the signature date of the NOV/CO, correct Violations 1 and 3 by completing the following: a. Develop a list of intercompany profiles that have been used to ship waste to CHA within the last three years; b. Determine the amount of waste that has been shipped to the Facility under an intercompany profile per year for the last three years; and c. Schedule a meeting with representatives of the Director to discuss the information gathered and possible paths towards resolving Violations 1 and 3. (Over) Additionally, the Division requests Clean Harbors Aragonite, LLC sign the forthcoming tolling agreement (DSHW-2024-007622).
