Remobiliz ing is ex pens ive, and we point ed out to at t he t ime t his demolition work was being dis c us s ed t hat remobiliz ing might bec ome a problem later if they proc eeded with demolit ion at the t ime they did wit hout a RA P in plac e. Our unders t anding was t hat t he is s ues wit h dumping and tres pas s ing made it s o that demolit ion down t o s lab was a nec es s ary s t ep for the applic ant , and t hat t hey wis hed t o proc eed des pit e t his . However, one of our c ondit ions about t hem going forward wit h demolition was t hat it c ould only go down to s lab, and t hat we c an't pull the foundations wit hout a RAP. W e've never done any t hing lik e t hat on any other s it e, and we have to be c ons is tent here. As s uc h, unfortunat ely no, t hey c annot pull t he foundat ions at this t ime, even if y ou are ready t o field s c reen for releas e point s . The RA P requires a public c omment period, and pulling t he foundations t o field s c reen for removal has alway s been s een by t his program as part of the remedy for a s ite. P ublic c omment and public not ic e is required for t his . Pleas e let me k now if y ou have further ques tions . They are well awar e of this. Additionally, the foundation can act as a cap. Pulling the foundation w ithout the appropriate procedures in place to address potential impacts creates a lot of challenges and is inconsistent w ith how w e addr ess this issue progr ammatically. A RAP is designed to addr ess the unknowns, establish pr ocedur es and to outline a remedy. Ultimately, your client owns the land and can make that decision, but it runs against how w e implement the progr am.
