Director July 20, 2020 Rick Fonnesbeck Amalga Town Water 6590 North 2400 West Amalga, UT 84335 Dear Mr. Fonnesbeck: Subject: Water System Violation – Amalga Town Water UTAH03002 According to Division of Drinking Water (DDW) records, your system has failed to submit a Consumer Confidence Report (CCR) for the calendar year 2019. In order to document compliance with the rule, a copy of the report must be delivered to the systems consumers and the Division of Drinking Water by July 1st annually. EPA requires that we provide them with a list of systems that have not complied with this requirement. Your water system can appear on the EPA’s list which can result in further enforcement actions against this system. Therefore we advise that you give this matter your immediate attention. Failure to submit this report is a violation of Section R309-225-1 of the rules. This violation will result in the addition of 15 points to your system’s Improvement Priority System Score (IPS) and could adversely effect your water system’s rating (R309-400). Please note that as of July 1, 2020, there will now be a cost recovery fee associated to each CCR violation in the amount of $500.00. This fee will be reassessed each subsequent quarter until the CCR requirements have been met. The system will be invoiced for this cost recovery fee within 30 days from the date of this letter. Your water system can be returned to compliance and the IPS points will be removed when you submit a completed 2019 CCR report to DDW at brandismith@utah.gov. If the CCR is submitted and approved within 30 days from the RECEIPT of this letter, the cost recovery fee will be removed. If the CCR is Submitted and approved beyond the 30 days, Your water system will be returned to compliance, however the system will be required to pay the cost recovery fee of $ 500.00.
