Dear Mr. Frydenlund:

Pursuant to the Radioactive Material License, Energy Fuels Resources (USA) Inc. (EFR) submitted to
the Division of Waste Management and Radiation Control (Division) the annual surety estimate on
March 4, 2023. On March 23, 2023, the estimate was further updated with information dated
March 20, 2023.

The Division has reviewed the submittal and approves the surety amount of $23,825,436. This is an
increase of $1,951,890 from the currently funded $21,873,546. The Division will hold this review open
pending receipt of the revised surety instrument in the newly approved funding amount.
