Dear Mr. Ostermiller:
On May 23, 2024, a release of petroleum from a 250-gallon diesel tank was reported to the
Division of Environmental Response and Remediation (DERR) based on observation of petroleum
spills flowing on the floors and into the sewer drains in the basement.
In accordance with Utah Underground Storage Tank Rule R311-202 and R311-205-2, you are
required to report, control, abate, and characterize the release; define the extent and degree of
petroleum contamination; evaluate the risks to human health and the environment; and remediate
(cleanup) the release, as required by the DERR. A Site Check Report (SCR) must be submitted to the
DERR within 30 days of your receipt of this letter. This SCR should include a summary of the
emergency response actions taken to contain, absorb, clean up, and dispose of the petroleum spills,
and the abatement procedures taken to clean up the petroleum contamination in the impacted sewer
lines. Any relevant reports and photos from the emergency abatement contractors and the local fire
and health department should be included in this SCR.
