During the 2016 Utah legislative session, changes were made to some of
the fees within the underground storage tank (UST) program. The
annual registration fee, which had remained unchanged since 2003 was
increased from $100.00 to $110.00 for tanks that participate in the
Petroleum Storage Tank (PST) Fund and from $200.00 to $220.00 for
tanks that do not participate on the PST Fund. Additionally, a permit fee
was approved for new tank installations. Previously, the cost to the
State for administrative and field work associated with installing tanks
was covered with general program funds. Increasingly these costs were
being supplied out of the PST Fund, placing an undue share of program
costs onto Fund participants. By charging a specific fee for new tank
installations, those who require the services pay directly for them. The
new fee structure is a $500.00 base fee for all tank installation permits.
For those areas in the state where UST program staff conduct field
inspections during installations, an additional $200.00 per tank will be
assessed to cover those costs. All fee changes go into effect on July 1,
2016.

1. Certificates of Compliance are mailed at the start of December.
2. The Secondary Containment Tests to qualify for the rebate are due December 15.
3. Throughput forms are mailed out around March 15.
4. Throughput forms are due on April 30.
5. Annual tank registration and PST Fund fee invoices are mailed around May 15 and the
payment deadline for these fees is June 30.
6. Any facility that has not paid the annual fees by September 1 will lose PST Fund coverage
and the certificate of compliance will lapse.

PUBLIC COMMENT TO NEW RULES
In response to Federal UST Rule changes, the State UST program is proposing changes to Utah’s
UST regulations. A copy of the current rule change proposal can be found on the web page at
http://undergroundtanks.utah.gov/proposed R311.htm. A formal comment period will be held later
this summer or early fall, so check the web site and watch for an email notifying you of your
opportunity to provide feedback on the proposed rule changes.

What’s Wrong With This Picture?

In the last newsletter, we started a new feature called “What’s Wrong With This Picture?” in
which there will be a photo that has something wrong with it. Can you determine what the
problem is here? Obvious, entertaining, and creative! The answer is below.
While the sensor is upright, it’s not in the lowest part of the containment sump and a
jerry-rigged bucket is not the correct way to fix a leak.

Testing will be conducted each month on the first Tuesday at 9:00 a.m. and the third Tuesday at 2:00 p.m. at
the DEQ/DERR office located at 195 North 1950 West, Salt Lake Ci ty. All students must register with the
