Rod and Dale,
Hope you are all well. Per the Big Plains Water and Sewer Special Service Sewer District’s request to have a new 8” line
be installed through the Mountain View Estates Subdivision, we have finally prepared the water report for your review. We
unsuccessfully tried a variety of times to contact the district to confirm current sourcing and water connection numbers.
Please review the report and let us know if you have any questions or need things updated.
I have also provided the construction plans that were reviewed previously by Dale.
Paul Wright is included in this email to let him know that this report and plan that will be coming his way.

Which water system is the mountain view estate subdivision in? If it is in Cedar point area and on their water system, then
they are definitely having water capacity issues which only can be resolved by adding another water source. They had to
turn off a well last year and they are down to one well that only produces about 35 gallons per minute. If that is the case,
then I cannot approve a water line for expansion of their system until this is resolved.

Thank you for the update Paul. I knew that the sourcing was an issue but had not heard about the downed well.
This water line was meant to improve flows to an existing 6” water line that was installed north of the subdivision a long
time ago.
I will reach out to the developer and contractor and let them know.
We have continued to work with contractors and developers in the Cedar Point water system. Every time I have brought
up the sourcing issue (which came to our attention during the Farrar Development) they explain that they have already
spoken to the Big Plains Water and Sewer Special Service District with instructions on how to install the water
infrastructure. In the example of this subdivision, after hearing that the district gave them instructions for the water line
buildout. I called up the water master to confirm the plans with him. The water master approved the plans and I finished
creating the construction documents. Due to an overloaded work schedule this plan was placed on the back burner and I
failed to finish the water model and submit both to the district and to you.
I have been confused as to why I keep getting the message to continue construction drawings when the water sourcing
problem should stall all construction. This may be due to the eagerness and “deaf” ears of developers. I have spoken to

Dale many times about the sourcing issue. I know his stance is to focus on fixing the issue rather than magnifying it.
However, I still get these conflicting messages from the district and contractors that Construction is still allowed. Of
course, all of these conversation happened months ago before the well was put out of use. I also have not been involved
in the embroiled politics that I have heard about up in Apple Valley. From here on out, we will take the stance that
development in the Cedar Point area is not possible until sourcing is corrected.
We would love to be a help in any way we can to get the sourcing problem resolved.

I know the Big Plains SSD has approached the Division of Drinking Water to see about some emergency funding to help
get some new source water. I have not heard where that went.
If these waterlines are just replacement lines and won't add new lots, then that is just and O&M issue. But if new lots are
being considered, then we really can't move forward.

Dale Harris told us the day after the moratorium was set that we could install all lines, just not charge or turn on any
services. The pipe is onsite and going to sun rot if we don’t get it in the ground.
To be clear, the 8” line or main line was required by Dale Harris at JUC meeting for a loop on the existing system to hep
with flow and pressure as the existing 6” line has 2 fire hydrants and a water service to a home on it currently. My client
has agreed to pay for and install said 8” line to fix a problem created by others.

So, just to be clear. You told us we could install and wait for later for the water issue we bought the pipe and now your
saying we can not install it. Is that correct?

Good Morning Paul,
I am not sure what deals are being worked out for this new water line in Mountain View Estates in Apple Valley. The
emails included below are the written discussion I have had with you and others concerning this new line in the Cedar
Point Water System. The most recent email to Andrew Lounsbury (owner) was to explain my perspective and history on
the new waterline in question.
From what I understand, the system is source deficient and nothing should be added to that system until that is fixed. That
said, Richard Fischer just asked me to send over the updated set of drawings that he, and I guess Dale Harris, requested
in order to install this line. I’ll send that string of emails about installing the line after this one. Per that request, please see
this link for the most-up-to-date plan set for Mountain View Estates.
I am also including the same water report that was sent to you before.
There is a lot going on up there in Apple Valley. In order to avoid the mess and the possible involvement in lawsuits
between the town and developers we have backed away from as many jobs in Apple Valley as we can until things settle
down.

Here is the last string of emails that were sent between Paul Wright, Dale Harris, and myself. When this project started we
had preliminary approval from water. Due to a loaded work schedule and oversight I did not begin the water model and
report until after construction had begun. These emails were the first communication that Paul Wright had seen on this
project.
We had gone through this same process before on the Farrar development which is when I found out about the source
deficiency in the Cedar Point Water System. Due to this deficiency Paul also did not approve their new water line. In
phone calls with Dale Harris after that news he explained the predicament that he was is between the state and the
wants/politics of Apple Valley. He would go back in forth in the conversation saying that he just can’t allow these home to
be built but then would turn full circle and say, “I guess I will just have to let them connect and hope the new source line is
installed by then.” The Farrars had already received their will serve letters. At that point I just backed away knowing that
he would still allow them to connect. We performed the test and provided the results. What they did with that was up to
them. I honestly was not sure what to do in that situation. In my opinion I thought that the hard decision should have been
taken to stop construction and put all attention on improving the system’s sources.
When Richard told me about your project at the beginning I brought up my concern that this would not be approved by
Dale. Then I called over to Dale to confirm that he would be approving the new six lots and the new water line. I was
surprised when I confirmed that conversation. After the confirmation I went to work to draw things up. I had sent plans to
him before for him to review. I remember him being okay with the plans and I considered the plans ready forgetting that a
submittal to he state was needed for the new water line. Unfortunately my email history does not have emails save from
back then and I did not save them.
After this string of emails I received another email from Richard saying that Dale would allow your new water line to be
installed. I sent the plans to Dale and Richard but I actually never heard back from Dale. I’ll send that to you as well.

Jeff and Dale,
Thanks for sending this. In the analysis that you provided, the hydraulic pressures appear to be adequate in that area
and the design and installation of the pipe itself would meet the DDW requirements. If this water line is intended currently
for looping and will not have homes connected to it for water service, then the Big Plains SSD - Cedar Point can approve
the installation of the water line on their own as just operation and maintenance for the time being. This would not require
my approval.
As you know, I can't formally approve these water line plans until the source capacity issue is resolved on the Cedar point
system. When this source capacity issue is resolved, then these plans can be approved with the new proposed
connections. I will keep these in my records until that time.

Okay, thank you. I assume you are limiting these pumping rates because of the use of VFDs?
So based on the numbers you have provided here,
The numbers in the analysis that we can use are:
Jessup Well - 47 gpm (47 gpm is the safe yield and you are equipped at a potential of 48 gpm, so the limiting factor is
the safe yield or 47 gpm)
Well 59 - 72 gpm (72 gpm is the safe yield and you are equipped at a potential of 90 gpm, so the limiting factor is the
safe yield or 72 gpm)
New Cook Well - 105 gpm (108 gpm is the safe yield and you are equipped at a potential of 105 gpm, so the limiting
factor is the equipped rate of 105 gpm)
This comes to a total available source capacity of 47 + 72 + 105 = 224 gpm which is more than 158.5 gpm (required
source capacity)
The source capacity analysis is close to this (108 vs 105 gpm for New Cook Well) so I can move forward with notifying the
DDW that the source capacity deficiency can be removed and I can work on issuing plan approval for this subdivision.
