Dear Randy Ward: On July 1, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-510-8(1)(a) regarding required equalization storage for the Day Star Adventist Academy (the System). According to this rule, public water systems shall provide equalization storage volumes to satisfy the average day demands of water. The System is classified as a Community system with a population of about 35. The System is served by one well (WS001) with artesian pressure. The well water is pumped to a 2,500-gallon hydropneumatic tank (HD001) where the pressure is maintained between 40 and 60 psi. The 2020 Sanitary Survey determined that the System requires 6,000 gallons of equalization storage capacity. The System maintains that the artesian nature of the well (WS001) is sufficient to displace the need for an additional 3,500 gallons of storage thus meeting the intent of R309-510-8(1)(a). The 2020 Sanitary Survey also determined that the required source flow for the System to be 8.3 gallons per minute (gpm). Documents and measurements provided by the System have demonstrated that the Well (WS001) has a consistent flow of 30 to 40 gpm. The additional water produced by the artesian well is used for irrigation and other non-essential purposes. Exception Request The basis for your request for an exception to R309-510-8(1)(a) regarding required equalization storage requirements is that the System maintains the following conditions to meet the intent of the rule. The System maintains the existing hydropneumatic tank (HD001) with a minimum pressure of 40 psi. The System has adequate supply because the flow of the artesian well, 30 gpm, far exceeds the required supply flow of 8.3 gpm. Because of the artesian flow of the Well (WS001), the System has adequate storage with the 2,500-gallon hydropneumatic tank (HD001) as demonstrated by service history without additional storage. On this basis, an exception to R309-510-8(1)(a), regarding required equalization storage requirements, is hereby granted for the Day Star Adventist Academy System #10012. This Temporary Exception expires on August 31, 2027. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal prior to August 31, 2027. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by August 31, 2027, will result in the activation of the deficiency related to not having sufficient equalization storage capacity. This Temporary Exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception. Please maintain a copy of this letter with your permanent records for future reference.
