Director May 23, 2024 Edwin Gibbs Rainbow Bay Campground 2045 E Main Canyon Rd Wallsburg, Utah 84082 Subject: NOTICE OF VIOLATION-TREATMENT TECHNIQUE VIOLATION, RAINBOW BAY CAMPGROUND UTAH26092 Edwin Gibbs: The Division of Drinking Water records indicate that your system is in violation of the State of Utah Public Drinking Water Rules R309-211-9(2)(b) for failure to complete seasonal start-up procedures for a seasonal system. This violation is documented as: • Violation Code 2D – Failure to complete seasonal start up procedures: April 2024 This violation results in the addition of 50 points to your system’s Improvement Priority System Report (IPS) and could adversely affect your water system’s rating (R309-400). To return to compliance and to have the 50 IPS points removed from your record, please complete the seasonal start-up form, and submit it to ddwreports@utah.gov. The form can be found online at seasonalstartup.utah.gov. Failure to complete seasonal start-up procedure is classified as a Tier 2 violation; therefore, the system must provide Tier 2 public notice as specified in Rule R309-220-6. The system must provide the public notice as soon as practical, but no later than 30 days after the date of this letter. Proof of public notification must be provided to the Division of Drinking Water at ddwreports@utah.gov within 30 days of notifying the water system customers and resubmitted each quarter the violation remains unresolved. Please refer to the enclosed sample of a Tier 2 public notice. Please be aware that failure to provide public notice will result in the addition of 50 IPS points to your system’s IPS report. Edwin Gibbs Page 2 of 4 May 23, 2024 If this letter is in error and you did complete the required seasonal start-up procedures, please send the seasonal start-up form as soon as possible within the next 30 days to ddwreports@utah.gov. We ask that you respond to this letter as soon as possible and that you reference your water system’s number in all correspondence with the DDW.
