Shelley Executive Director DIVISION OF DRINKING WATER Nathan Lunstad Director Stephen Brown, President realtorstevebrown@gmail.com Foothill Water Users Association 2268 North Cottontail Dr. Cedar City, Utah 84721 Subject: Federal SRF Loan Authorization; Foothill Water Users Association, System #11099, Loan #3F2006 Dear Steve Brown: On November 7, 2023, the Drinking Water Board authorized a loan of $603,030, with $181,030 in principal forgiveness, for a net repayable amount of $422,000 for 40 years at 0% interest to Foothill Water Users Association for the construction of a new 250,000-gallon tank, resolve well deficiencies, and to install water meters and fire hydrant risers (hereinafter called the "Project"). On June 25, 2024, the Drinking Water Board authorized an additional $188,554 to the previously authorized construction loan for a new loan total of $791,554 for 40 years at 0% interest with $237,554 in principal forgiveness, for a net repayable amount of $554,000, to Foothill Water Users Association. The financial assistance is subject to the same conditions and requirements as stated in the authorization letter dated November 28, 2023, to Foothill Water Users Association. With the signing of the Bipartisan Infrastructure Law on November 15, 2021, there is a new requirement for Federal SRF projects. The Build America Buy America Act (BABAA) goes into effect on May 14, 2022. All federal financial assistance recipients that close their assistance agreement on or after this date will be required to comply. The Utah DWSRF Program has created an interim Build America Buy America Requirements sheet for your reference. Please note, this sheet should be included in construction contract documents before a project is advertised for bids. Also, please be aware that these requirements may change once the Office of Management and Budget issues final guidance on implementing BABAA requirements.
