This Temporary Exception Expires on December 31, 2025
Dear Ben Sessions:
On June 30, 2024, your Temporary Exception to R309-515-4(3), Number of Sources and
Quantity Requirements expired. This temporary exception was issued on February 23, 2023. The
rule states community water systems serving more than 100 connections shall have a minimum of
two sources, except when served by a surface water treatment plant.
Peterson Pipeline Association currently serves an approximate population of 460 residents,
including 140 residential connections and 2 commercial connections. Current source availability
for the system consists of the existing Peterson Well (WS001) with a pumping capacity of 300
gallons per minute (gpm).
Peterson Pipeline Association has been continuing to acquire a second ground water source. In
association with the development of a second water source, the Division of Drinking Water (the
Division) has previously received the following information for the proposed Well #2 (WS002).
Plans and specifications for borehole and well drilling.
Recorded Land Use Agreement with future homes for protection zones.
Exception Request
The basis for your renewal request for an exception to R309-515-4(3), Number of Sources and
Quantity Requirements is that Peterson Pipeline is ongoing in their pursuit of the completion of a
second ground water source and is requesting time to complete the well drilling, well equipping,
and connection to the Peterson Pipeline distribution system.
Well Driller Mike Zimmerman has been retained by Peterson Pipeline and has begun drilling of the proposed well WS002. The well drilling is estimated to be completed by August 2024. Peterson
Pipeline has also retained Sunrise Engineering to design and oversee the well equipping and well house construction. Site geotechnical work has been completed, along with the site survey
and base mapping. Sunrise Engineering has submitted a project schedule with a December 2025 completion date.
In the event of an emergency water need, water will be provided to Peterson Pipeline Association from the Highlands Water Company (HWC, System #15005), in accordance with the signed
water hauling contract submitted to the Division signed September 1, 2021. Peterson Pipeline Association and Highland Water Company recognize that a public water system may only use
water hauling during emergencies and follow the conditions described in R309-550-10, Water Hauling.
On this basis and due to your continued work and efforts in completing the project, a renewal temporary exception to R309-515-4(3), Number of Sources and Quantity Requirements, is hereby
granted for Peterson Pipeline Association.
This Temporary Exception expires onDecember 31, 2025.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to December 31, 2025.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
This Temporary Exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.The issuance of this exception temporarily resolves your water system’s deficiency related to theTGR7 COM SYSTEM SERVING 100 OR MORE CONNECTIONS LACKS REDUNDANTSOURCE. An updated
IPS report is available at https://waterlink.utah.gov. Please contact JenniferYee at (385) 515-1501 or jyee@utah.gov for questions related to your water system’s IPS reportor deficiencies.
Please maintain a copy of this letter with your permanent records for future reference.
