Dear Mr. Anderson:
Re: Regulatory Status of Materials Testing
My staff has reviewed your April 21, 1992 submittal and concurs
with your conclusions that testing can be done on products
samples that have been distinctively altered to exhibit some
degree of degradation. Also, as indicated by Susan during the
March 11, 1992 meeting, the open burning/open detonation of waste
materials are not allowed under the Treatability Study provisions
of R315-2-1.3(f)(6) of the Utah Administrative Code (the Rules).
Please be advised that any residues generated during the testing
would not be excluded for the hazardous waste requirements and
would need to be managed in accordance with the applicable
provisions of the Rules. In addition please contact this office,
prior to testing, if it becomes necessary to conduct testing on
any waste materials not generated by Hercules.
