Dear Mr. Peterson, Our office was initially notified verbally of the release from the above referenced tank on July 17, 1989. Written confirmation of the release from Hercules followed on July 28, 1989 indicating that approximately 3000 gallons of acid leaked from the tank into a pea gravel bed. It is also our understanding that this acid tank has been removed from service and contains an unknown quantity of sludge. The contents of the tank must be analytically characterized so as to determine if they meet the definition of a hazardous waste. This determination will dictate management strategies of the sludge. Once the tank has been emptied of it's contents, subsequent use, reuse, or disposal is not subject to regulation under the Utah Administrative Code. Any soils contaminated by the spilled acid must be analytically characterized so as to determine if they meet the definition of a hazardous waste. If the soil is determined to be a hazardous waste it must be removed to an approved hazardous waste management facility. Removal and characterization of soils should continue until all contaminated soil meeting the definition of hazardous waste has been addressed. Contaminated soils remaining on-site must be subjected to appropriate actions so that they no longer present a hazard. R450-9-3 of the Utah Administrative Code requires that the person responsible for the spill initiate all necessary actions to clean up the spilled material, residue, contaminated soil, water, or any Le Roi Peterson page two other material resulting from the spill. The Executive Secretary may require additional action to protect human health or the environment if the initial cleanup has been determined to be inadequate. The party responsible for the spill must keep our office informed of all activity related to the remediation and provide our office with all analytical results.
