Dear Mr. Gooch:

The Division of Waste Management and Radiation Control is currently reviewing ATK’s Class 2 Permit
Modification Request to establish operating conditions and limits for the thermal treatment of energetic
wastes at ATK’s Promontory Facility. The Division received the modification request from ATK on
July 26, 2016.

In accordance with R315-270-42(b)(6)(i) of the Utah Administrative Code, the Director shall make a
determination on the modification request no later than 90 days after it is received. However, a 30-day
extension to this period is allowed by R315-270-42(b)(6)(ii). The 90-day period ends on October 24,
2016. Since additional time is needed to make a determination on the request, the Division is notifying
ATK that a determination will be made no later than 120 days after the request was received or by
November 23, 2016.
