Box 144880 Salt Lake City, Utah 84114-4880 Attention: JeffVandel Re: ATK Launch Systems-Promontory EPA ID number UTD009081357 Minuteman Missile Liner and Insulation Information as Requested - Request for Claim of Business Confidentiality Dear Mr. Anderson: Enclosed is the information request by the Utah Division of Solid and Hazardous Waste ("UDSHW" or the "Division") regarding the liner, insulation and propellant components of the Minuteman Missiles that are manufactured and occasionally treated by open burning at our facility. ATK Launch Systems Inc. ("ATK") requests that the information accompanying this letter be protected as business confidential information as allowed under Utah Code Section 63G-2-305. ATK specifically request that the information associated with this letter be protected as per Utah Code Section 63G-2-309 for the following reasons: 1) The accompanying information contains specific information concerning the ingredients and formulations of ATK propellants, explosives and rocket motors which are considered proprietary and should be protected as trade secrets and intellectual property. 2) The accompanying information contains technical data within the definition of the International Traffic in Arms Regulations (ITAR), and is subject to the export control laws of the U.S. Government. Transfer of this data by any means to a foreign person, whether in the U.S. or abroad, without an export license or other approval from the U.S. Department of State is prohibited."
