Box 707 Brigham City, UT 84302-0707 RE: Missing Flares, Kosmo Test Range ATK Launch Systems – Promontory Facility UTD009081357 Dear Mr. Gooch: This letter is in response to the Kosmo Test Range Emergency Permit Reports that ATK has been submitting to the Division since July 2006. The Division has requested that ATK submit these “follow-up” reports in order to record information regarding the treatment of flares that fail to deploy as designed during testing. Based on the information that has been provided, there are a number of these defective flares at the test range that ATK has been unable to recover. ATK considers flares that have not deployed as designed to be reactive hazardous waste. ATK has maintained that these partially or completely unburned flares are too dangerous to collect and remove to ATK’s RCRA permitted open burning grounds. To address this issue, ATK has requested emergency permits from the Division in order to treat the flares in place by open burning once they are located. ATK has provided information on its efforts to recover some of the missing flares in the follow-up reports. However, the Division requests that ATK provide the following additional information: • What is the total number of flares that have not been recovered and treated? • Where are the missing flares thought to be? Please provide a map showing these locations and the test range boundaries. • What is the status of the land (ownership, under lease, etc.) where the missing flares are thought to be located? • Is there public access to the locations of the missing flares?
