Box 144880 Salt Lake City, Utah 84114-4880 Dear Mr. Downs: ATTENTION : Otis Willoughby SUBJECT: Partial Closure Plan M-13 6 Burn Grounds On 11 November 1992, Thiokol Corporation submitted the referenced closure plan to the Division of Solid and Hazardous Waste. On 24 June 1994 the Utah Solid and Hazardous Waste Control Board approved the plan. Thiokol was later informed that the plan had been approved without the required public comment period. In subsequent conversations with personnel from your staff, Thiokol learned that the cover letter accompanying the plan to public comment indicated that the plan had already been approved by the DSHW and following the pending public comment period, Thiokol could commence closure activities. Thiokol is uncertain as to the date when the required public comment period ended, and consequently when the 180 days for completing the closure are up. The scil saiapl-i-Rg*-recfuirsd in the closure plan v/as completed on 9 November 1994 and the laboratory results were received by Thiokol on 10 January 1995. The data is currently being reviewed and evaluated using the methods described in the plan. Thiokol requests that the DSHW consider the events pertaining to the approval of this plan and clarify the closure period. In the event the closure period is near expiration, Thiokol requests the DSHW to extend the period for 90 days to allow completion.
