Dear Mr. Gosen:

The Division of Solid and Hazardous Waste has conducted a final review of the Environmental Covenant for the M-136 disposal site. The Division requests a change to the language in Paragraph
16(b) to reflect the lack of encumbrances on the property. The recommended change is as follows:

(b) that the Owner holds fee simple title to the Property which is free, clear and unencumbered;

Please note that this recommended change eliminates the reference to “Exhibit B” which was incorrect. The correct reference should have been “Exhibit C.”

The Division has printed a new page for the covenant that includes the revised Paragraph 16(b). In addition, I have signed the document as the Executive Secretary of the Utah Solid
and Hazardous Waste Control Board and enclosed it with this letter. The Division is returning the covenant to you so that ATK may consider the recommended change, and if acceptable,
have the document recorded by Box Elder County. In accordance with Paragraph 18 of the covenant, ATK is required to provide the Division with a file and date-stamped copy of the recorded
Environmental Covenant.
