RE: Environmental Covenants for the M-636, M-508 and M-136 Sites, ATK Launch Systems - Promontory Facility, EPA I.D. #UTD009081357

Dear Mr. Gosen:

The Post-Closure Permit conditions in Section III.A., Use of Property, require that institutional controls be implemented for the hazardous waste management sites at M-636, M-508 and
M-136. ATK Launch Systems has prepared Environmental Covenants, in accordance with the Utah Uniform Environmental Covenants Act, for two of these sites in order to meet these permit
requirements.

The Division of Solid and Hazardous Waste received the completed Environmental Covenant for the M-636 site on December 3, 2007. This document was recorded by the Box Elder County Recorder’s
Office on November 29, 2007. With this Environmental Covenant in place, the requirements of Section III.A., Use of Property, have been met for this site.

A draft of the environmental covenant for the M-508 site was received by the Division on October 15, 2007. This draft has been reviewed by the Division. The Division requests one change.
Please remove the signature block for Rick Sprott, Executive Director, Utah Department of Environmental Quality. The current policy for the Department is to have the Division Directors
sign these documents. Please proceed with finalizing the document for the M-508 site and return it to the Division for Dennis Downs’ signature within 60 days of receipt of this letter.

The Division renews its request that ATK prepare an environmental covenant for the
M-136 LTTA. This requirement was included in the recently issued Post-Closure Permit because it appears that the deed notation for the area, recorded with the Box Elder County Recorder
on October 3, 1986, falls short of the requirements of the Post-Closure Permit and the Utah Uniform Environmental Covenants Act. In addition, it would be preferable to have the same
institutional control in place for all three sites. The Division requests that a draft Environmental Covenant for the M-136 LTTA be submitted to this office for review within 90 days
of receipt of this letter.
