Dear Mr. Gosen:
On Saturday, September 23, 2006, ATK Thiokol contacted Jeff Vandel of my staff to request an emergency permit for the treatment of hazardous waste, by detonation, at building M-188.
Based on the information that was provided, oral approval for the emergency permit was granted and the detonation was conducted on the morning of September 24, 2006. A written request
for the emergency permit was received by the Division of Solid and Hazardous Waste on September 25, 2006.
According to the information that was provided by members of your staff, an unplanned explosion occurred at building M-188 on Friday, September 22, 2006 at approximately 3:30 pm. It
was reported that approximately 680 pounds of energetic material exploded in the accident that occurred in Bays #1 and #2 of the building. During an examination of the building after
the blast, it was discovered that additional, un-reacted material remained in Bay #4. As a result of the blast, this material was covered with a portion of a concrete wall and other
rubble. As stated in your letter, ATK’s Incident Response Team determined that the un-reacted, energetic material was unsafe to move, and that the only safe way to manage the material
was to detonate it in-place. An emergency permit was required so that the un-reacted, energetic material, now characterized as a hazardous waste, could be treated by detonation at the
building.
Enclosed is Utah Hazardous Waste Emergency Permit #UT-057-2006 providing Thiokol authorization for the treatment of hazardous waste as described above. This permit, which is based on
the information provided by Thiokol, became effective on September 23, 2006 and

expired on September 25, 2006. Emergency permits are issued under the authority of 19-6-101 through 105, Utah Code Annotated, as amended and R315-3-6.2.
It is stated in your letter that the treatment (detonation) was successful and the reaction of the energetic hazardous waste appeared to be complete. In addition, it is stated that
ATK Thiokol will submit a follow-up letter to the Division after further investigation is complete. The Division requests that ATK Thiokol provide a post-treatment report that will
include the following information: a description of the final cleanup of the site, the management of waste materials generated as a result of the treatment, and an assessment of the
release of hazardous constituents to the environment. Please submit the post-treatment report no later than seven days after cleanup of the site is complete.

Pursuant to the Utah Solid and Hazardous Waste Act, 19.6.101-122, et. seq., Utah Code Annotated as amended and the Utah Administrative Code (R315-1 through R315-13, R315-50 and R315-101)
as adopted by the Utah Solid and Hazardous Waste Control Board, an emergency permit is issued to ATK Thiokol Inc. - Promontory (hereafter called the ”Permittee”) to treat, by open detonation,
approximately 550 pounds of reactive hazardous waste at building M-188. State of Utah Administrative Rules allows for the application of an emergency permit pursuant to R315-3-6.2 if
an imminent and substantial endangerment to human health or the environment is present. The Permittee has requested an emergency permit based on its determination that the hazardous
waste could not be safely moved and that the only safe way to manage the material was to detonate it in-place. U.S. Environmental Protection Agency has authorized the Executive Secretary
to issue such a permit under Section 3006(b) of the Resource Conservation and Recovery Act.
The Permittee shall comply with all terms and conditions of this permit. The permit consists of all applicable portions of R315-1 through R315-13, R315-50, and R315-101 incorporated
by reference. Applicable rules are those which are in effect on the date of issuance of this permit. All waste generated from the treatment shall be properly characterized and transported
to an approved disposal facility. In addition, the Permittee shall submit a post-treatment report, no later than seven days after cleanup of the site is complete. The post-treatment
report shall include a description of the management of waste materials and final cleanup of the site, and an assessment of the release of hazardous constituents to the environment.
This permit is based on the premise that the information provided by ATK personnel on September 23, 2006 is accurate and that the treatment of hazardous waste will be conducted as specified.
The Permittee shall inform the Executive Secretary of any deviation from, or changes in the information provided which could affect the Permittee's ability to comply with the applicable
regulations. Any inaccuracies or misrepresentations in the information provided may be grounds for the termination of this permit, in accordance with R315-3-6.2(b)(4) of the Rules.
This permit is effective on September 23, 2006 and expires on September 25, 2006.

NOTICE
The Executive Secretary of the Utah Solid and Hazardous Waste Control Board has issued an emergency hazardous waste treatment permit (# UT-057-2006) to the ATK Thiokol Inc. – Promontory
facility. This permit was issued so the facility could treat, in accordance with the Utah Hazardous Waste Management Rules, energetic material stored in Building M-188. The material
was impacted by an unplanned explosion at Building M-188 on September 23, 2006 and as a result, determined to be a hazardous waste. The permit was effective on September 23, 2006 and
expired on September 25, 2006. Utah Administrative Rules allow application for an emergency permit if an imminent and substantial endangerment to human health or the environment is
present. Thiokol personnel requested an emergency permit to treat the hazardous waste in-place by open detonation based on the determination that the waste could not be safely moved
to the Open Burn/Open Detonation grounds.
Copies of the permit are available for public inspection during normal business hours, or other hours with prior arrangement, at the Division of Solid and Hazardous Waste, 4th floor
