Box 707 Brigham City, UT 84302-0707 RE: Utah Hazardous Waste Emergency Permit UT-047-2006, ATK Thiokol Inc. – Promontory Facility, EPA I.D. #UTD009081357 Dear Mr. Gooch: The Division of Solid and Hazardous Waste received your request, dated July 27, 2006, to issue an emergency permit for the storage of reactive hazardous waste in the M-136 burn trays. As described in your letter, ATK Thiokol Inc. (Thiokol) may only store hazardous waste received from off-site at its Burn Grounds for a period of 24 hours before it must be treated. An emergency storage permit was required since additional time was needed to safely treat the waste. The reactive hazardous waste in question was received from the ATK Thiokol, Bacchus facility at 11:30 am on Wednesday, July 26, 2006. Thiokol notified the Division on the afternoon of July 26, 2006 that, due to safety concerns, the waste couldn’t be treated within 24 hours. The waste consisted of 7,615 pounds of class 1.3C propellant solid and 1,818 pounds of class 1.3C explosive substances. The hazardous waste was shipped on manifest number UTD00170502902764. Enclosed is Utah Hazardous Waste Emergency Permit #UT-047-2006 providing Thiokol authorization for the storage of hazardous waste as described above. This permit, which is based on the information provided by Thiokol, became effective on July 27, 2006 and expired on July 29, 2006. BOX 707 BRIGHAM CITY, UT 84302-0707 Pursuant to the Utah Solid and Hazardous Waste Act, 19.6.101-122, et. seq., Utah Code Annotated as amended and the Utah Administrative Code (R315-1 through R315-13, R315-50 and R315-101) as adopted by the Utah Solid and Hazardous Waste Control Board, an emergency permit is issued to ATK Thiokol Inc. - Promontory (hereafter called the “Permittee”) to store a total of 9,433 pounds of reactive hazardous waste at the M-136 Burn Grounds. State of Utah Administrative Rules allow for the application for an emergency permit pursuant to R315-3-6.2 if an imminent and substantial endangerment to human health or the environment is present. The Permittee has requested an emergency permit based on its determination that the reactive hazardous waste could not be safely treated within the 24-hour period allowed for waste received from off-site locations. U.S. Environmental Protection Agency has authorized the Executive Secretary to issue such a permit under Section 3006(b) of the Resource Conservation and Recovery Act. The Permittee must comply with all terms and conditions of this permit. The permit consists of all applicable portions of R315-1 through R315-13, R315-50, and R315-101 incorporated by reference. Applicable rules are those which are in effect on the date of issuance of this permit. In addition, all waste generated from the treatment shall be properly characterized and transported to an approved disposal facility. This permit is based on the premise that the information provided in a letter dated July 27, 2006 and through discussions with ATK personnel, is accurate and that the storage of hazardous waste will be conducted as specified. The Permittee must inform the Executive Secretary of any deviation from, or changes in the information provided which could affect the Permittee's ability to comply with the applicable regulations. Any inaccuracies or misrepresentations in the information provided may be grounds for the termination of this permit, in accordance with R315-3-6.2(b)(4) of the Rules. This permit is effective on July 27, 2006 and shall expire on July 29, 2006. Signature: Date: ____________ Dennis R. Downs, Executive Secretary Utah Solid and Hazardous Waste Control Board NOTICE An emergency hazardous waste storage permit (# UT-047-2006) has been issued by the Executive Secretary of the Utah Solid and Hazardous Waste Control Board to the ATK Thiokol Inc. – Promontory facility. This permit was issued so the facility could store, in accordance with the Utah Hazardous Waste Management Rules, hazardous waste at its open-burning grounds. The permit was effective on July 27, 2006 and expired on July 29, 2006. Utah Administrative Rules allow application for an emergency permit if an imminent and substantial endangerment to human health or the environment is present. Thiokol personnel requested an emergency permit to store hazardous waste at its burn grounds based on the determination that the waste could not be safely treated within the 24-hour period that is allowed for hazardous waste received from off-site locations.
