Box 707 Brigham City, UT 84302-0707 RE: Temporary Authorization Request to Store Reactive Waste Received From Off-Site at the M-136 Open Burn Grounds, Tracking #06.02715 ATK Thiokol Inc. – Promontory Facility, EPA I.D. #UTD009081357 Dear Mr. Gosen: The Division of Solid and Hazardous Waste (the Division) received your request for a temporary authorization to store reactive hazardous wastes received from off-site, in burn trays at the M-136 Burn Grounds. As stated in your letter, ATK Thiokol-Promontory (ATK), requests authorization to store these wastes for up to 14 days prior to open burning and will work with the state to complete a Class II permit modification for ATK’s Storage Permit. Based on your explanation of why the temporary authorization is necessary, it appears that it would facilitate changes to protect human health and the environment before action can be taken on the permit modification request. However, the Division requests that ATK provide more detailed information on the storage of hazardous wastes, as described above, in the burn pans. As stated in 40 CFR §270.42(e)(2)(ii)(C) (incorporated by reference in R315-3-4.3), the temporary authorization request must include sufficient information to ensure compliance with 40 CFR part 264 (R315-8) standards. Please provide specific information on how ATK will comply with all applicable R315-8-9, Use and Management of Containers standards. If a requirement doesn't apply to your situation, please so indicate in the letter. Of particular interest are the requirements for the condition of containers (R315-8-9.2), inspections (R315-8-9.5 and R315-8-2.6), and containment (R315-8-9.6). In addition, please describe the containers that will be used, how they will be managed and labeled, and include a copy of the inspection form that will be used by personnel at M-136 to comply with the inspection requirements.
