Dear Mr. Gooch:

The Division of Solid and Hazardous Waste (the Division) has received your request for an emergency permit to treat, by open burning, one Castor 120 rocket motor (approximately 120,000
lbs of class 1.3C propellant). ATK Thiokol Inc. (Thiokol) has determined that it is unsafe to move the rocket motor to the permitted open burning facility, since the roof of the storage
bunker has collapsed on it. Accordingly, Thiokol requested an emergency permit to burn the motor in-place.

Based on the information provided in your letter dated October 11, 2005 and through discussions held with you and Gene Curtis of your staff, the Division concurs that an emergency permit
is needed to treat the rocket motor as requested. Enclosed is Utah Hazardous Waste Emergency Permit #UT-034-2005 providing Thiokol authorization for the treatment of the waste rocket
motor and any unburned or ejected propellant that is discovered after the motor is burned. This permit is based on the premise that the information provided by Thiokol is accurate and
that the treatment will be conducted as specified in your letter.

This permit becomes effective on October 22, 2005 and shall remain in effect until November 22, 2005. Should Thiokol complete the treatment activity prior to November 22, 2005, the
permit will terminate on that date. Emergency permits are issued under the authority of 19-6-101 through 105, Utah Code Annotated, as amended and R315-3-6.2.

Pursuant to the Utah Solid and Hazardous Waste Act, 19.6.101-122, et. seq., Utah Code Annotated as amended and the Utah Administrative Code (R315-1 through R315-13, R315-50 and R315-101)
as adopted by the Utah Solid and Hazardous Waste Control Board, an emergency permit is issued to ATK Thiokol Inc. - Promontory (hereafter called the “Permittee”) to treat, by open burning,
one Castor 120 rocket motor (approximately 120,000 lbs of class 1.3C propellant) and any unburned or ejected propellant that is discovered after the motor is burned. State of Utah Administrative
Rules allow application for an emergency permit pursuant to R315-3-6.2(a) if an imminent and substantial endangerment to human health or the environment is present. The Permittee requested
an emergency permit based on its determination that it is unsafe to move the motor to the permitted open burning facility, since the roof of the storage bunker has collapsed on it, and
that the only safe way to manage the motor is to burn it in-place. The U.S. Environmental Protection Agency has authorized the Executive Secretary to issue such a permit under Section
3006(b) of the Resource Conservation and Recovery Act.

The Permittee must comply with all terms and conditions of this permit. The permit consists of all applicable portions of R315-1 through R315-13, R315-50, and R315-101 incorporated
by reference. Applicable rules are those that are in effect on the date of issuance of this permit. In addition, all waste generated from the treatment shall be properly characterized
and transported to an approved disposal facility.

This permit is based on the premise that the information provided in a letter dated October 11, 2005 and orally by the Permittee subsequent to the letter, is accurate and that the treatment
will be conducted as specified. The Permittee must inform the Executive Secretary of any deviation from, or changes in the information provided which could affect the Permittee's ability
to comply with the applicable regulations. Any inaccuracies or misrepresentations in the information provided may be grounds for the termination of this permit, in accordance with R315-3-4.4(a)(2).

This permit shall remain in effect from October 22, 2005 until November 22, 2005, unless terminated in accordance with R315-3-4.4. Should Thiokol complete the treatment activity prior
to November 22, 2005, the permit will terminate on that date.
