Box 707 Brigham City, UT 84302-0707 RE: Closure of Waste Motor Storage Buildings, ATK Thiokol Propulsion – Promontory, EPA I.D. #UTD009081357 Dear Mr. Gooch: This letter is in response to your correspondence dated September 15 and October 2, 2003 regarding the closure of three waste motor storage buildings and the revision of the ATK Thiokol Propulsion – Promontory (Thiokol) Closure Plan. The Division of Solid and Hazardous Waste (the Division) agrees with your proposal to complete the closure of storage buildings M-107, M-340 and S-616 before re-writing the Closure Plan. The plans for closing these buildings were written and approved in January 1999 and are still appropriate. Please be advised that your request for a waiver from the requirement for certification of closure by an independent professional engineer for these buildings cannot be approved. The Hazardous Waste Management Rules do not contain provisions for such a waiver. Once closure is complete, the Storage Permit will need to be modified to remove all references to the closed buildings. This will require a Class 1 Modification, at the request of the permittee, with prior approval from the Executive Secretary. The Division requests that Thiokol submit its permit modification request, as outlined in 40 CFR §270.42(a), after the Division has verified the closure certification. In addition, Thiokol can discontinue providing financial assurance for buildings M-107, M-340 and S-616 once the verification of closure from the Division is received. It is requested that Thiokol submit its revised Closure Plan for the other regulated units at Promontory to the Division within 45 days of receiving the closure verification letter.
