Box 707 Brigham City, UT 84302-0707 SUBJECT: Utah Hazardous Waste Emergency Permit UT-21-98 Issued to the Thiokol Corporation Dear Mr. Hancock: Enclosed is Utah Hazardous Waste Emergency Permit #UT-2l-98 providing Thiokol authorization to treat approximately twelve IR flares by open burning at their Promontory facility. This permit was issued verbally on May 5, 1998. Based on information provided by Thiokol, the flares were rendered unstable as the result of incomplete burning during a test procedure. It was determined to be unsafe to collect the flares and transport them to the open burning facility. Therefore, the Emergency Permit was necessary so that the waste could be treated in place. This permit became effective on May 5, 1998 and will expire on May 8, 1998. The permit was issued under the authority of 19-6-101 through 105, Utah Code Annotated, as amended and R315-3.19(a). Bailey, M.D., M.S.P.H., Health Officer/Department Director Bear District Health Department, w/enclosure Kathy Barker, DSHW f:\...\jvandel\e-permit\thio598.cl file to; Thiokol STATE OF UTAH EMERGENCY PLAN APPROVAL UT-21-98 Permittee: Thiokol Corporation Brigham City, Utah Pursuant to the Utah Solid and Hazardous Waste Act, (the Act), 19.6.101-122, et. seq., Utah Code Annotated as arrended and the Utah Administrative Code (UAC) (R315-1 through R315-13 and R315-50) as adopted by the Utah Solid and Hazardous Waste Control Board, an emergency plan approval (herein after called "permit") is issued to the Thiokol Corporation (hereafter called the "Permittee"), to treat approximately twelve flares by open buming at their Promontory facihty from May 5, to May 8, 1998. The flares were rendered unstable as the result of inconplete burning during a test procedure. It was determined to be unsafe to collect the flares and transport them to the open burning facility, therefore the Emergency Permit was necessary so that the waste could be treated in place. The U.S. Environmental Protection Agency has authorized the Executive Secretary to issue such a permit under Section 3006(b) of the Resource Conservation and Recovery Act (RCRA). The Permittee must comply with all the terms and conditions of this permit. The permit consists of the applicable portions of R315-1 through R315-13, R315-50, and R315-101 incorporated by reference. Applicable rules are those which are in effect on the date of issuance of this permit. This permit is based on the premise that the information provided to the Executive Secretary beginning on April 29, 1998 is accurate. Any inaccuracies or misrepresentations found in the application may be grounds for the termination of this permit (see R315-3-19). The Permittee must inform the Executive Secretary of any deviation from, or changes in the information in the application which would affect the Permittee's abihty to comply with the applicable regulations. This permit is effective as of May 5, 1998 and shall expire on May 8, 1998 unless terminated in accordance with R315-3-19. Signature: Date: ^A/fr Dennis R.
