We have not been utilizing the T-93/94 permitted tanks in recent months. It is still undetermined as to whether or not we have development work that will be done at this facility. Section IV.G.S of our permit states that all tank systems identified in section IV.B will be certified by an independent professional engineer every 12 months. This 12 month period comes due on 8 February 1996. In light of the fact that we have not used these tanks for some time, and we are unsure if operations at this facility will continue, we would like to tag these tanks as "out-of-service" and not have them recertified at this time. Prior to any use of the tanks, a new certification would be submitted to the State. Mr. Willoughby indicated in a phone conversation on 5 February that this approach would be acceptable to the state. We will assume that this practice is appropriate unless we hear otherwise. "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system design to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fines and imprisonment of knowing violations." Thank you for your help as always.
