Dear Mr. Downs
SUBJECT: RD&D Annual Tank Certifications, EPA # UTD009081357
The T93/94 Permit states we are to keep the executive secretary informed as to the future status of the
permitted facility. We have not been utilizing the T-93/94 permitted tanks in recent months. It is still
undetermined as to whether or not we have development work that will be done at this facility.
Section IV.G.S of our permit states that all tank systems identified in section IV.B will be certified by an
independent professional engineer every 12 months. This 12 month period comes due on 8 February
1996. In light of the fact that we have not used these tanks for some time, and we are unsure if
operations at this facility will continue, we would like to tag these tanks as "out-of-service" and not have
them recertified at this time. Prior to any use of the tanks, a new certification would be submitted to the
State.
Mr. Willoughby indicated in a phone conversation on 5 February that this approach would be acceptable
to the state. We will assume that this practice is appropriate unless we hear otherwise.
"I certify under penalty of law that this document and all attachments
