Jenkins Parsons, Behle & Lattimer One Utah Center 201 South Main Street Suite 1800 Sah Lake City, Utah 84145-0808 Dear Ms. Jenkins: The Division of Solid and Hazardous Waste (the Division) received your letter requesting confirmation of a waste determination made by Thiokol Corporation and that Barrick Resources (USA) is not subject to any solid waste regulations. The Division concurs that the silver contaminated soils associated with the photographic waste sites are not to be considered hazardous, assuming that the soils do not fail the TCLP test, nor are they subject to solid waste regulations. This determination was confirmed in the approved closure plans for the photographic waste sites dated December, 1993, and in a letter from the Division to Thiokol dated November 2, 1993.
